“ If the domicile of such person is not known, [4] the law of the country where the person has his residence shall be applied. ในกรณีใด ๆ ที่มีการขัดกันในเรื่องสัญชาติของบุคคล ถ้าสัญชาติหนึ่งสัญชาติใดซึ่งขัดกันนั้นเป็นสัญชาติไทย กฎหมายสัญชาติซึ่งจะใช้บังคับ ได้แก่ กฎหมายแห่งประเทศสยาม In any event where a conflict of nationalities of a person is present, if one of the nationalities in conflict is the Thai nationality, the law of nationality to be applied is the law of the country of Siam. ”

“ However, no Siamese court shall order such a person to be placed under custodianship or curatorship by virtue of the grounds which the law of Siam does not permit. ผลของการให้อยู่ในความอนุบาลหรือให้อยู่ในความพิทักษ์ดังกล่าวแล้ว ให้เป็นไปตามกฎหมายของประเทศซึ่งศาลที่สั่งให้บุคคลเช่นว่านั้นเป็นผู้ไร้ความสามารถหรือเป็นผู้เสมือนไร้ความสามารถสังกัดอยู่ The effect of placing [a person] under the said custodianship or curatorship shall be in accordance with the law of the country to which the court that has ordered such person incompetent or quasi-incompetent belongs. ”

“ In the event that no intention, [either] express or implied, can be ascertained, if the parties have the same nationality, then the law to be applied is the law of common nationality of the parties, [or] if the parties do not have the same nationality, then the law of the place where the contract was made shall be applied. ”
