“ The appellate division ordered judgment for the defendant. The Supreme Judicial Court reversed that order and directed the trial court to enter judgment for the plaintiff. Weiss v. Director General of Railroads, 144 N. E. 765, 250 Mass. 12. This court granted a writ of certiorari (45 S.C.t. 229, 267 U.S. 588, 69 L. Ed. 801) on January 26, 1925.Since then, Davis v. L. L. Cohen & Co., Inc., 45 S.C.t. 633, 268 U.S. 638, 640, 642, 69 L. Ed. 1129, has settled that a suit against a railroad company is not a suit against the Director General ”
