“ A court of equity will not stop half-way in the investigation of a fraud which is quite apparent, to give one of the parties to it affirmative relief at the expense of the other. In such cases better is the condition of the defendant.It is also argued that the fraud was against the creditors of the company, and the assignee can pursue the party who defrauded them. ”
