“ As the Co-Prosecutor filed a final appeal stating that the Accused deserves the penalty of death and the two inferior courts should not have reduced the penalty in favour of the Accused because there is no mitigating circumstance in the case, all the points in [this] final appeal are based on questions of fact, causing the final appeal of the Co-Prosecutor to fall under the prohibition of the said legal provision. The final appeal of the Co-Prosecutor, though accepted by the court of first instance, is illegitimate. The Supreme Court [hereby] refuses to rule upon it. ”
