“ Notwithstanding any other provision of these rules, members of the armed forces or their agents may not intercept wire or oral communications for law enforcement purposes unless such interception:
`` (1) takes place in the United States and is authorized under subdivision (b) ; `` (2) takes place outside the United States and is authorized under regulations issued by the Secretary of Defense or the Secretary concerned; or `` (3) is authorized under regulations issued by the Secretary of Defense or the Secretary concerned and is not unlawful under section 2511 of title 18, United States Code. ”

“ Rule 302 of the Military Rules of Evidence is amended by changing paragraph (b) (2) to read as follows:
``An expert witness for the prosecution may testify as to the reasons for the expert's conclusions and the reasons therefor as to the mental state of the accused if expert testimony offered by the defense as to the mental condition of the accused has been received in evidence, but such testimony may not extend to statements of the accused except as provided in (1) . ́ ́. ”
