“ TERRITORY DEFINED- In this paragraph, the term `territory' means any of the following territories of the United States: American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, or the United States Virgin Islands. (4) ADDITIONAL FUNDS- (A) IN GENERAL- No additional funds shall be provided for any project or activity under subsection (c) , or paragraph (1) or (2) of this subsection, that the Secretary of Transportation determines was sufficiently funded before or during fiscal year 2009 to achieve the authorized purpose of the project or activity. ”

“ AVAILABILITY FOR OBLIGATION- Funds authorized to be appropriated by this section shall be-- (A) made available under this section and available for obligation in the same manner as if the funds were apportioned under chapter 1 of title 23, United States Code, except that the funds shall retain the characteristics of the funds originally rescinded; and (B) subject to a limitation on obligations for Federal-aid highways and highway safety construction programs included in an Act making appropriations for fiscal year 2010 or a portion of the fiscal year. ”

“ Highways Trust Fund- (1) HIGHWAY ACCOUNT- Paragraph (1) of section 9503 (c) is amended-- (A) by striking `September 30, 2009 (October 1, 2009' and inserting `December 31, 2010 (January 1, 2011'; and (B) by striking `under' and all that follows and inserting `under the Surface Transportation Extension Act of 2010 or any other provision of law which was referred to in this paragraph before the date of the enactment of such Act (as such Act and provisions of law are in effect on the date of the enactment of such Act) .'. ”
