“ Petitioner contends that the postponement of the execution of the sentence of death pronounced against him, by virtue of an order of the supreme court of the District in general term on January 21, 1892, and subsequent postponements by that court in special term, were without anthority of law, and in violation of section 845 of the Revised Statutes of the District, and that, therefore, he is unlawfully kept and detained without due process of law, and in violation of the constitution of the United States. ”
