National People's Congress Basic Law of the Hong Kong Special Administrative Region (1990)

Upholding national unity and territorial integrity, maintaining the prosperity and stability of Hong Kong, and taking account of its history and realities, the People's Republic of China has decided that upon China's resumption of the exercise of sovereignty over Hong Kong, a Hong Kong Special Administrative Region will be established in accordance with the provisions of Article 31 of the Constitution of the People's Republic of China, and that under the principle of "one country, two systems," the socialist system and policies will not be practised in Hong Kong.

Clause 1 of Annex I of the Basic Law stipulates, "The Chief Executive shall be elected by a broadly representative Election Committee in accordance with this Law and appointed by the Central People's Government." Clause 2 stipulates, "The term of office of the Election Committee shall be five years." Setting up an Election Committee with a five-year term, whose statutory responsibility and task is none other than electing the Chief Executive, and one of its important aims is to facilitate the selecting of a new Chief Executive in time when that office becomes vacant during those five years.

The freedom and privacy of communication of Hong Kong residents shall be protected by law. No department or individual may, on any grounds, infringe upon the freedom and privacy of communication of residents except that the relevant authorities may inspect communication in accordance with legal procedures to meet the needs of public security or of investigation into criminal offences.
