17. Definitions
(1) In this Part— “election” (選舉) means an election to elect all the members to be returned to the Legislative Council by all the geographical constituencies;
“geographical constituency” (地方選區) in relation to an election means a geographical area having separate representation (whether by one or more members) in the Legislative Council;
“population quota” (標準人口基數) , in relation to an election, means the total population of Hong Kong divided by the total number of members to be returned by all the geographical constituencies in that election. ”

“ Where a body corporate commits an offence under this Ordinance in respect of any act which is proved to have been committed with the consent or connivance of, or to be attributable to any act on the part of, any director, manager, secretary or other similar officer of the body corporate or any person purporting to act in any such capacity, he, as well as the body corporate, commits the offence. ”

“ Any reference to an alien (or to similar terms or expressions) shall be construed as a reference to a person other than a citizen of the People’s Republic of China. 21. Any provision saving the rights of Her Majesty, Her Heirs and Successors shall be construed as saving the rights of the Central People’s Government of the People’s Republic of China and the rights of the Government of the Hong Kong Special Administrative Region under the Basic Law or other laws. ”

“ A magistrate may, if he is satisfied by information on oath that there are reasonable grounds for suspecting that there is in any place—
(a) any optical disc which has been manufactured in contravention of this Ordinance; or (b) any machinery, equipment or other thing which may be or may contain, or which may likely be or contain, evidence of an offence under this Ordinance, issue a warrant authorizing an authorized officer to enter and search the place. ”

“ A person is not eligible for appointment as a member of the Commission or to hold office as such—
(a) if he is nominated as a candidate for election as Chief Executive; (b) if he is a member of the Selection Committee; (c) if he is or becomes a member of the Election Committee referred to in Annex I to the Basic Law; (d) if he is or becomes— (i) a member of the Executive Council; (ii) a member of the Provisional Legislative Council or the Legislative Council ”

“ An Ordinance to provide for the imposition of sanctions against places outside the People’s Republic of China arising from Chapter 7 of the Charter of the United Nations, and to provide for matters incidental thereto or connected therewith. ”

“ Where the affairs of a body corporate are managed by its members, subsection (1) applies in relation to the acts of a member in connection with his functions of management as if he were a director of the body corporate. ”

“ Subsection (1) shall not be construed as affecting—
(a) any power which is for the time being conferred (either exclusively or inter alia) by or under the law of a country or territory outside Hong Kong on notaries outside the jurisdiction of that country or territory; (b) any power which is for the time being conferred on notaries by the law of nations or which is so conferred by the law of a community, association or group of states established by or formed pursuant to a treaty, convention or other international agreement. ”

“ An authorized officer may seize, remove or detain any vessel, aircraft or vehicle (other than a ship of war, military aircraft or military vehicle) which he is empowered by this section to stop, board and search and which he reasonably suspects is being used, or to have been used, in connection with an offence under this Ordinance. ”

“ The national flag, when hoisted or lowered from a vertical staff, shall be hoisted or lowered slowly. When hoisted, the national flag must reach the peak of the staff; when lowered, it may not touch the ground. ”

“ A person acting in good faith in aid of an authorized officer under subsection (2) is not liable for any loss or damage suffered by any person as a result of any action taken or omitted to be taken by him while so acting.
(4) Nothing in this section shall affect any civil liability of the Government for the wrongful acts of its servants. ”

“ For the purpose of this Ordinance, a person manufactures optical discs in Hong Kong if he owns, directs, manages or otherwise has control of a business in Hong Kong which includes the manufacturing of optical discs in Hong Kong.
(3) All other words and expressions used in this Ordinance and defined in the Copyright Ordinance (92 of 1997) have the same meaning as in that Ordinance.

(1) No person shall manufacture optical discs in Hong Kong unless he holds a valid licence. ”
