No doubt the petition was defective. A right to the penalty arises only where § 4 is violated 'by knowingly assisting, encouraging, or soliciting the migration or importation' of an alien contract laborer into the United States. Knowledge being an element of what is penalized, it must be included in the statement of a cause of action for the penalty.
