Henry Billings Brown,
Panama Company v. Napier Shipping Company…
“ Andrews was either apprised of, or put upon inquiry as to, all the acts with regard to the location of the sunken dredge, respondent cannot be chargeable with negligence because it did not warn him specially against the spindle, since it had not been informed of its existence by the diver, who does not seem to have been guilty of any negligence in not discovering it, and for whose negligence it is at least doubtful whether respondent would have been liable. ”
