It is insisted that, in consequence of the error of the court, the roll prepared in accordance with its orders contains the names of numerous persons not entitled under the mandate of this court to participate in the fund.
The respondent opposes these contentions and makes the counter one that petitioners have been guilty of laches, which, if it be justified, makes a notice of other contentions unnecessary.
