“ Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he is hereby, authorized to deliver to the proper authorities of the respective States in which the regiments which bore these colors were organized certain Union and Confederate battle flags, now in the custody of the War Department, for such final disposition as the aforesaid proper authorities may determine. ”

“ That if at any time said military organization shall cease to exist, or should fail to use said property for military purposes, then the same shall revert to the city of Chattanooga, Tennessee, as provided in Resolution Numbered Fifty-six, approved October first, eighteen hundred and ninety. And it is further reserved to the United States the right to use said lands for military purposes at any time upon the demand of the President of the United States. ”
