“ The only question is whether a third person has the right to use a private wharf on tendering reasonable compensation therefore, because there is no other wharf at the place, or because it would be more convenient to such third person to so use it, or because the former owner of the wharf had permitted the public to use it, although the present owner refused to consent to such use. There is no more reason why such property should be held subject to the right of others to use it against the will of its owner than there is for any other kind of property to be so held. ”
