International Court of Justice Accordance with international law of the unilateral declaration of independence in respect of Kosovo (2010)

The Court observes that it is not required by the question it has been asked to take a position on whether international law conferred a positive entitlement on Kosovo unilaterally to declare its independence or, a fortiori, on whether international law generally confers an entitlement on entities situated within a State unilaterally to break away from it. Indeed, it is entirely possible for a particular act – such as a unilateral declaration of independence – not to be in violation of international law without necessarily constituting the exercise of a right conferred by it.

Ukraine considers that the Russian Federation “has turned the Genocide Convention on its head”, making a false claim of genocide as a basis for actions on its part that constitute grave violations of the human rights of millions of people across Ukraine. It asserts that, rather than taking military action to prevent and punish genocide, the Russian Federation should have seised the organs of the United Nations under Article VIII of the Convention or seised the Court under Article IX thereof.

It is the United Nations Charter that is ultimately to guide any reasoning. In his view, Kosovo's declaration of independence can only be appropriately considered in the light of the complex and tragic factual background of the grave humanitarian crisis of Kosovo, which culminated in the adoption by Security Council of its resolution 1244 (1999) . The Law of the United Nations has been particularly attentive to the conditions of living of the population, in Kosovo as in distinct parts of the world, so as to preserve international peace and security.
