United States District Court for the Eastern District of New York, December 2010, United States v. Turner (09 CR 650…
“ The criminal justice system simply could not function if an individual’s effort to intimidate a judge through threats of violence were protected from prosecution and punishment. Threats of violence in general, moreover, are both unprotected by the First Amendment and inimical to it. In this case, when Turner used the Internet to issue threats of violence, he sought not to persuade, but to coerce by intimidation. Turner traded on fear of violence in a way that has no place within the marketplace of ideas. ”
