“ By a long line of decisions in this court it has been settled that, where the state Constitution as construed by the state court of last resort does not provide otherwise, the Legislature of a state may require that the cost of a local public improvement, such as the construction or reconstruction of a public road, be distributed over the lands particularly benefited and charged against them according to their value, their area, or the benefits which they will receive; may itself determine what lands will be benefited, and in what proportions they will share in the benefits ”
