STATE REQUIREMENT.− If a State requires, in addition to the essential health benefits required under section 1323 (b) (3) (A) , coverage of services described in subparagraph (B) (i) for enrollees of a community health insurance option offered in such State, the State shall assure that no funds flowing through or from the community health insurance option, and no other Federal funds, pay or defray the cost of providing coverage of services described in subparagraph (B) (i) .

SMALL EMPLOYER- The term `small employer' means, in connection with a group health plan with respect to a calendar year and a plan year, an employer who employed an average of at least 1 but not more than 100 employees on business days during the preceding calendar year and who employs at least 1 employee on the first day of the plan year.
