Term of office

“ Every person holding any civil office to which he has been or hereafter may be appointed by and with the consent of the Senate, and who shall have become duly qualified to act therein, shall be entitled to hold such office during the term for which he was appointed, unless sooner removed by and with the advice and consent of the Senate, or by the appointment, with the like advice and consent, of a successor, in his place, except as herein otherwise provided. ”

“ D. When the office of President of the Republic is vacant, the functionary who shall take it constitutionally as his substitute must issue, within the definite term of fifteen days, the summons to proceed to a new election, which shall be held within the term of three months, and in accordance with the provisions of Article 76 of this Constitution. The provisional President shall not be eligible to the presidency at the elections which are held to put an end to his provisional term. ”

“ The term of office for the Vice-President shall be the same as that of the President. Upon the expiration of the term, three candidates, possessing the qualifications of article 1, shall be nominated by the re-elected or the new President, for election. The regulations governing the election of the President shall be applicable.
Should the Vice-President vacate his post before the expiration of his term for some reasons, the President shall proceed according to the provisions of the preceding article.
Art. 15. The Law shall be enforced from the date of promulgation. ”

“ The executive power shall be vested in a president of the United States of America. He shall hold his office during the term of four years, and, together with the vice-president, chosen for the same term, be elected as follows:
Each state shall appoint, in such manner as the legislature thereof may direct, a number of electors equal to the whole number of senators and representatives to which the state may be entitled in the congress; but no senator or representative, or person holding an office of trust or profit under the United States, shall be appointed an elector. ”

“ We favor appointments based upon merit, fixed terms of office, and such an administration of the civil-service laws as will afford equal opportunities to all citizens of ascertained fitness. "We declare it to be the unwritten law of this Republic, established by custom and usage of 100 years, and sanctioned by the examples of the greatest and wisest of those who founded and have maintained our Government, that no man should be eligible for a third term of the Presidential office. ”

“ This went one step further, and declared, that no member should be appointed to an office which had been created with or without his concurrence, before or after he was a member. Whenever a man accepted an office which he was reasonably expected to hold, for a definite term, he should continue to hold it for that entire period, unless some very strong reason existed to the contrary, and which had not existed prior to his appointment. ”

“ Each member of the Federal executive is elected by a separate ballot, and holds office for the fixed term of three years, during which he cannot be turned out of office, while as yet but a single instance has occurred of the rejection of a Federal councillor who offered himself for re-election. ”

“ The President of the Republic shall be elected for a term of five years by direct universal suffrage. No one may carry out more than two consecutive terms of office. The manner of implementation of this article shall be determined by an Institutional Act. ”

“ Each Governour or President of a State shall hold his office until a successor be actually appointed, unless he die, or resign or be removed from office by conviction on impeachment. There shall be no appointment of such Governor or President in the Recess of the Senate. ”

“ As no President has yet discovered a disposition to hold the office more than eight years, it may be considered by some as having grown into a law, that no one shall hold the office for a longer period. ”

“ Under the constitution, the President and heads of departments are to make nominations for office, the Senate is to advise, and consent to appointments, and the House of Representatives is to accuse and prosecute faithless officers. The best interest of the public service demands that these distinctions be respected; that Senators and Representatives who may be judges and accusers should not dictate appointments to office. ”

“ Where the constitution and the statutes are silent as to the qualificaition for a given office, the people may elect whom they will, if the person so elected is competent to discharge the duties of the office. ”

“ The office, if it be properly called an office, is created by that Constitution, and by that alone. It also declares how it shall be filled, namely, by election. Its language is: 'The House of Representatives shall be composed of members chosen every second year by the people of the several states, and the electors in each state shall have the qualifications requisite for electors of the most numerous branch of the state legislature.' Art. ”
