“ And the Constitutional Court has thereafter ruled in a similar manner, that the Copyright Act, 2537 BE, section 74, the Telecommunications Business Act, 2544 BE, section 78, the Entertainment Facilities Act, 2509 BE, section 28/4, and the Fertilisers Act, 2518 BE, section 72/5, are repugnant or contradictory to the Constitution of the Kingdom of Thailand, 2550 Buddhist Era, section 39, paragraph 2, and are no longer applicable according to the Constitution of the Kingdom of Thailand, 2550 Buddhist Era, section 6. ”

“ At present, there are problems of reproducing [copyrighted works] by recording without permission either sound or picture or both sound and picture of films, either Thai or foreign, during their screening in cinemas, and reproducing them in various media, as CDs or DVDs, for instance, for further disposal, [1] causing considerable economical damage to the film industry and related businesses, to the detriment of the ordinary exploitation of copyrighted works by the owners of the copyrights or the persons permitted to use the rights. ”

“ The following shall not be deemed copyright works under this Act:
news of the day and facts having the character of mere information, not being works in the literary, scientific or artistic fields; the constitution and legislation;' regulations, bylaws, notifications, orders, explanations and official correspondence of the Ministries, Departments or any other government or local units ”

“ Section⁠1.⁠This Act is called the "Copyright Act (No. 4) , 2561 BE". มาตรา⁠๒⁠พระราชบัญญัตินี้ให้ใช้บังคับเมื่อพ้นกําหนดหนึ่งร้อยยี่สิบวันนับแต่วันประกาศในราชกิจจานุเบกษาเป็นต้นไป Section⁠2.⁠This Act shall come into force upon elapse of the period of one hundred and twenty days reckoned from the date of its publication in the Government Gazette onwards. มาตรา⁠๓⁠ให้ยกเลิก (๙) ของวรรคสองของมาตรา ๓๒ แห่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. ๒๕๓๗ ซึ่งแก้ไขเพิ่มเติมโดยพระราชบัญญัติลิขสิทธิ์ (ฉบับที่ ๓) พ.ศ. ”
