It is charged in the assignment of errors that the decision of the court of appeals was erroneous-First, because it recognized the right of the defendant to acquire a water right as against the United States; and, second, because it held that the water right of the defendant, which originated after the establishment of the reservation, could deprive the reservation of water necessary for its purposes.
