“ We have boasted of "rights," but the suspicion is rife that the majority of men have never understood a tithe of their rights, and that the rights which our institutions assure are possibly not more than a tithe of the goods upon which complete men will insist. We have appealed to "ethics," but at this late day there is no more open question than. What is ethical? We declare the sacredness of life, but men are asking, What is life? What does life presume? What does life involve? What should life contain? To whom does the prerogative of life belong? ”

“ All moral laws, I wish to shew, are merely statements that certain kinds of actions will have good effects. The very opposite of this view has been generally prevalent in Ethics. ‘The right’ and ‘the useful’ have been supposed to be at least capable of conflicting with one another, and, at all events, to be essentially distinct. ”

“ A free act is an act which so proceeds from the will that under the same antecedent conditions it might have not proceeded.
An act may be more or less voluntary, and more or less free.
5. Moral Philosophy is divided into Ethics, Deontology, and Natural Law. Ethics consider human acts in their bearing on human happiness; or, what is the same thing, in their agreement or disagreement with man's rational nature, and their making for or against his last end. Deontology is the study of moral obligation, or the fixing of what logicians call the comprehension of the idea I ought. ”

“ In any other view it is a maze, a mystery, a hopeless embroilment.
That ethics is involved in society is of course admitted; what is not admitted is, that ethical terms should be settled under the social science in the first place. I may refer to the leading term "law," whose meaning in sociology is remarkably clear; in ethics remarkably the reverse. The confusion deepens when the moral faculty is brought forward. In the eye of the sociologist, nothing could be simpler than the conception of that part of our nature that is appealed to for securing obedience. ”

“ It is to be particularly observed, further, that the obligation, thus perceived and then felt, is perceived and felt as due by the moral agent with respect to right and wrong. The ethical quality of rightness belongs to the act or principle of action. The motive, the intention, the conduct of men, is in itself morally right or wrong, good or evil. But the obligation appears as what is owed by the moral agent to what is right. The relation between right and obligation corresponds to that between right and duty. Right is in the conduct; duty is for the responsible person. ”

“ Any one, who finding the impossibility of accounting for the right of the present possessor, by any received system of ethics, should resolve to deny absolutely that right, and assert, that it is not authorized by morality, would be justly thought to maintain a very extravagant paradox, and to shock the common sense and judgment of mankind. ”

“ This view of morality, which, for the most part, is indorsed by modern thought, makes ethics dependent upon sociology for its criteria of rightness or wrongness. Indeed, we cannot argue any moral question nowadays unless we argue it in social terms. ”

“ While with regard to the matter of Ethics,—the general classifications of right and wrong conduct,—moralists are almost unanimous, with regard to its form,—the essence and criterion of right and wrong,—there is great disagreement. All widely spread opinions deserve respect by their mere existence; they are phenomena to be accounted for. To say that there is no rightful principle—that the morally good has no more right than the morally bad—would be not only absurd to reason, but fly in the face of the spontaneous and ineradicable sense of mankind, which makes the moral distinction. ”

“ But free-will has also been discussed pragmatically, and, strangely enough, the same pragmatic interpretation has been put upon it by both disputants. You know how large a part questions of ACCOUNTABILITY have played in ethical controversy. To hear some persons, one would suppose that all that ethics aims at is a code of merits and demerits. ”

“ To get such a sane and far-sighted moral perspective; to see the acts of our fellow men with a proper valuation; to be able to point out the insidious dangers of conduct which is not yet as generally rebuked as it ought to be; and at the same time to emancipate ourselves and others from the mistaken and merely arbitrary precepts that are intermingled with our genuine morality, and so attain the largest possible freedom of action, such should be the outcome of a thorough study of ethical principles and ideals. ”

“ The imposition of some recognized rules of conduct, safeguarding the security of life and property, is as necessary to the community as the existence of a coinage for the negotiation of commercial bargains; in fact it is more so. The two are analogous: the moral code must give effect to that first and universal principle of ethics expressed thus, "Do unto others as you would they should do unto you," which is only another way of saying, "You may expect others to treat you as you intend to treat them in similar circumstances." ”

“ In its applicatory judgments, for fixing the ethical law of right in all the varied and complex relations and conditions of human life, it is dependent on all the subordinate faculties for the requisite light. Whatever limitations may rest on its ability, whatever partialness may mark its development, whatever complications may perplex it in adjusting duty to all the actual situations in human life, it yet remains the faculty through which the law of duty is disclosed to view, and if duty is not indicated through it, it is not indicated through any human insight at all. ”

“ There are many duties that belong to the class of imperfect obligations, which are binding on conscience, but which human laws do not and cannot undertake directly to enforce. But when the aid of a Court of Equity is sought to carry into execution ... a contract, then the principles of ethics have a more extensive sway. ”

“ In all this wide sphere obligation can be met only through his endowment with power to carry into effect, in action, his moral judgments and convictions of right. Moral science must consider man not merely as a knower and contemplator or lover of the right, but also as a doer of it in righteous deeds. Hence man's moral nature, as his endowment for the moral life, is not all brought under review until it is seen to include the realm of his feelings and those executive powers which turn the ethical discriminations and choices into righteous conduct. ”

“ The effect of ignorance of the causes of right, equity, law, and justice, is to make custom and example the rule of actions, as with children, or to induce the setting of custom against reason, and reason against custom, whereby the doctrine of right and wrong is perpetually disputed, both by the pen, and by the sword. ”

“ On the other hand, it is contended, and in a sense rightly contended, that with men as they are, and society as it is, the dictates of absolute morality are impracticable. Legal control, which involves the infliction of pain, alike on those who are restrained and on those who pay the cost of restraining them, is proved by this fact to be not absolutely moral, seeing that absolute morality is the regulation of conduct in such way that pain shall not be inflicted. ”

“ Extreme cases in which moral laws may be suspended.—The particular duties, virtues, and laws which society has established and recognized are the expressions of reason and experience declaring the conditions of human well-being. As such they deserve our profoundest respect; our unswerving obedience. Still it is impossible for rules to cover every case. There are legitimate, though very rare, exceptions, even to moral laws and duties. For instance it is a duty to respect the property of others. ”

“ From right use of such affection or actions as are approved by the moral faculty from their relation to the general good, or the good of particular persons consistently with the general good, he distinguishes the right of a man to do, possess, demand, &c., which exists when his doing, possessing, &c. tend to the good of society, or to his own, consistent with the rights of others and the general good, and when obstructing him would have the contrary tendency. ”

“ It is not towards the individual, but towards the moral person that one is obligated. Principle of all individual duties,—to respect and develop the moral person.—Social ethics,—duties of justice and duties of charity.—Civil society. Government. Law. The right to punish.
We know that there is moral good and that there is moral evil: we know that this distinction between good and evil engenders an obligation, a law, duty; but we do not yet know what our duties are. The general principle of ethics is laid down ”

“ But we may well ask if it really does make no difference whether this distinction, the "ethical ideal," comes as a perception of reality, the action of a knowing power, or as a "feeling" which perceives nothing and to account for which there is no perceived ethical reality, no discernment of the elemental ideas of right and wrong, upon which approval or disapproval can arise and rest. We are entitled to ask: How can there be a feeling of ethical approval when there is no insight of the distinction between moral good and evil? ”

“ Our fundamental ethical conception of him, however, is that of a moral being and moral ruler. And to be moral means to love and choose the right as right. We must keep in mind here the relation between moral law and will, or the choices of the will. Moral authority does not exist as will, but as right. ”

“ They have the right, which all men ought to have, of discussing freely any and every important question in ethics, jurisprudence, and political economy, but not to give their conclusion a direct and offensive application to those portions of their fellow-citizens or fellow-men, to whom they have not yet furnished a clear and satisfactory example, and rule of conduct in the case specially adverted to. ”

“ If, therefore, virtue is not to be disrobed of its honor, if righteousness is not to be cast down from the supreme place which the reason of mankind has ever accorded it, if the idea of duty is not to be belittled, invalidated and overthrown, ethical theory must recognize and emphasize the objective and permanent reality of the moral law as an unchanging law of obligation and responsibility for the conduct of free agents. Otherwise the so-called ethical theory is not a theory of the ethical reality, but one that sinks132 the supposed ethical reality into non-moral elements and illusion. ”

“ In the modern separation of ethics from theology and treatment of it as a science, it is not meant to deny the close affinity between the two investigations or the rich illumination that duty receives from supernatural revelation, but only to trace out more distinctly and fully, in independent and scientific form, the deep and immovable foundations of the principles of duty in the very constitution of man and the world. This exhibition of the natural basis of ethical law and obligation becomes an independent and generic enforcement of the principles of righteousness. ”

“ In such case they might plausibly, as they often do, affirm that the moral bond, being thus organically insured and fixed in the moral consciousness, must remain the same, no matter what theories, even though purely materialistic, may be formed of its genesis and nature. But so soon as the ethical reality is seen in its cosmic place and transcendental character we want an explanation not only of the ground of obligation to right conduct, but also of the ground of the right which evokes the sense of obligation. ”

“ The ethical dignity of the contents of the real objects, whose independence and sameness is presupposed, does not alter in the least the logical character of the category involved. Logic is not ethics, but the ethical categories must be logical. ”

“ During the transitional stages there are necessitated successive compromises between the moral code which asserts the claims of the society versus those of the individual, and the moral code which asserts the claims of the individual versus those of the society. ”

“ When the ethical feeling develops, upon the basis of sympathy, to the feeling of duty and justice, the principle included in the above law becomes the standard according to which the individual judges his own actions as well as those of others, and pronounces them good or bad. The good is that which preserves and develops the welfare of conscious beings. ”
