“ The fundamental rights recognized in this chapter shall not exclude those guaranteed by the fundamental law, nor the others, which enunciate human dignity, the principle of sovereignty of the people or the social and democratic state of law and the republican form of government. ”

“ Work shall be a right and social obligation. The state shall recognize its role in improving on the well-being and development of its national resources conditions to eradicate poverty, misery and ensure the equal occupation of its national territory and shield its citizens from need. ”

“ The province of Rio Muni comprises, in addition to the territory of this name, the islands of Corisco, Big Elobey and Little Elobey and adjacent islets. The province of Fernando Poo comprises the island of this name, the island of Annobon and adjacent islets. The Republic of Equatorial Guinea guarantees the independence, integrity and security of its territory and protects the autonomy of its provinces, in accord with what is decreed in this constitution. Art. 2. The national sovereignty belongs to the Guinean people, who exercise it in the form and within the limits of the Constitution. ”

“ Independently of what may one day be authorized by the Law on Nationality, those persons will be considered to be Guinean nationals who are of African ancestry and who were born in Equatorial Guinea , as will their children , even though the latter may have been born elsewhere , provided that in either case such persons now possess Spanish nationality . ”

“ The administration of justice corresponds to the Supreme Court and to those judicial organs specified by an Institutional law . The public judicial function will be regulated in accord with the principles of legality , immutability and responsibility. ”

“ All Equato-Guineans shall have the obligation to honor the father land and defend its sovereignty, its territorial integrity and national unity, factors which contribute to the peace, national security and traditional Equato-Guinean values and protect national interests. ”

“ Political parties shall be integral political organizations of persons who shall associate freely to participate in the political orientation of the state. They shall represent multipartism and democracy, and shall thus express popular will as the basis of any political participation. ”

“ The candidates to the Presidency must be nationals of Equatorial Guinea and be more than thirty years of age .
Art . 13 . The President of the Republic is the head of the Govern ment , and freely selects , appoints and dismisses the Ministers , who are the heads of their respective departments. At least one - third of the Ministers must be natives of each one of the provinces .
Art . 14 . The Vice - President will be a Minister appointed by the President from among the natives of a province other than the one of which he himself is a native . ”

“ Women, irrespective of their civil status, shall have the same rights and opportunities as her male counterpart at the political, economic, social and cultural levels, and at all levels of life; public, private or family ”

“ The state shall ensure the protection of every person from birth, and forster his normal development and ensure his security for his moral, psychological and physical integration as well as his family life.
It shall encourage and promote primary health care as the corners tone of the development of this sector.

Education shall be primordial to the state. Every person shall have the right to primary education people shall have the right to primary education which is obligatory and free ”

“ The private sector, which integrates companies owned by one or more physical persons or corporate bodies with private rights and, more generally, companies that do not fall under the sectors mentioned above. ”

“ Official education shall freely allow the institution of religious education, which is protected by the constitution.
Education that shall be officially recognized may not orientate a programme or propagate ideological or partisan tendencies. ”

“ The Assembly of the Republic is composed of 35 Deputies , elected every five years by universal , direct and secret vote . All of the Deputies represent the Guinean people and must serve the nation and the common welfare . ”

“ The judges and magistrates shall not enjoy any form of immunity in the exercise of their duties.
Item 88: The principle of the unity of the Judicial Power shall be the basis of the organization and functioning of courts. ”

“ Elect the President, Deputy Presidents and bureau among members. 2. Enact its by-laws. 3. Approve state expenses, revenues and investment budgets. The State through the tributary law, inspired in the principes of equality, generality and prosperity, establishes the taxes, obligations and exedents for-fiscal and the special circumstances that concur in each figure of taxes for its liquidation. All the physical or legal persons, national or stranger, residentes in the Republicof Equatorial Guinea have the obligation of paying the taxes imposed by law. ”

“ Its political parties shall not be allowed to have appellations similar to those that existed before October 12, 1968; their ambitions and perspectives shall have to be nationalistic and shall therefore, not be based on tribe, ethnic inclinations, religion, gender, district, municipality, social condition or profession. The law shall regulate their creations and functioning. ”

“ The declaration of a legal obstacle can only be based on an inten tional violation of the Constitution , or on facts that can substantiate a charge of serious criminal responsibility . From the moment of the Assembly's denunciation until such time as the Supreme Court declares the existence of incapacity or a legal obsta cle , the President will not be able to use his powers to dissolve the Assembly . ”

“ The expenditures of the budget covering aid for development will be distributed according to the economic criteria for the selection of in vestments , approved by the Institutional Law governing the Development Plan . The interests and amortization payments related to the Public Debt , credits , loans from international organizations and other financial opera tions, will be attributed to specific expenditures of the provinces in proportion to the volume of expenditures occurring in each of them . ”

“ The Higher Judicial Council shall head this organ. It shall comprise a President and six other members appointed by the Head of State for a period of 5 years.
The organic law shall regulate the structure, functioning and legal status of its members. ”

“ No member of the Assembly will be subject to prosecution , detention, imprisonment or trial because of opinions he may express , or votes he may cast , during the performance of his duties . While the Assembly is in a period of sessions , no member of the same may be prosecuted or arrested on a criminal charge without the au thorization of the executive council of the Assembly , except in cases of flagrante delicto . ”

“ The counselors will be elected by universal vote and their terms of office will coincide with that of the Assembly of the Republic . To be a provincial counselor it is required that the candidate be a Guinean na tional , of adult age and a native of the province or someone who has re sided there for more than ten years .
art . 46. Once constituted , each Provincial Council will proceed to elect its president . ”

“ The candidate who obtains an absolute majority of the votes cast will be elected to the Presidency . Should none of the candidates obtain this absolute majority , a new election will be held between the two candi dates who obtained the greater number of votes . Cases involving a tie vote will likewise be decided by a new election . The President - elect will take possession of his high office before the expiration of a ten - day period following the proclamation of the elec toral results . ”

“ In the case of a vacancy caused by death , incapacity on a legal obstacle charged against the President, the acting President will call for new Presidential elections within thirty days, unless more than three years of the former President's term of office should have elapsed , in which case the acting President will continue to perform the duties pro visionally assumed , until the expiration of the said tern . ”

“ The agreements on aid and technical assistance that the Guin ean government may negotiate in the future must facilitate the progressive Africanization of all the staffs within the country's Adininistration . ”
