Constitutional Court Act

“ Any decision that a statute is unconstitutional and a final interpretation on the Constitution shall bind the courts, other State agencies, and local governments. (2) Any statute or provision thereof decided as unconstitutional shall lose its effect from the date on which the decision is made. However, any statute or provision thereof relating to criminal punishment shall lose its effect retroactively. (3) The decision on competence disputes by the Constitutional Court shall bind all State agencies and local governments. ”

Constitutional Court Act

“ When any controversy on the existence or the scope of competence arises between state agencies, between a state agency and a local government, or between local governments, a state agency or a local government concerned may request to the Constitutional Court an adjudication on competence dispute. (2) The request for adjudication referred to in paragraph (1) may be allowed only when an action or omission by the defendant infringes or is in obvious danger of infringing upon the plaintiff's competence granted by the Constitution or laws. ”
