“ Construing, then, the confirmatory act, in connection with the general law of the United States, the recommendations of the surveyor general upon which the confirmation was made, and the essential requirements of the case as presented to congress, we conclude that a survey of the grant was contemplated by the confirmatory act, and we will determine the rights of the parties in accordance with this conclusion. ”
