“ Each Federal agency shall ensure that the agency will not grant a loan, loan guarantee, permit, license, or other assistance to an applicant who, with intent to avoid the requirements of section 106, has intentionally significantly adversely affected a historic property to which the grant would relate, or having legal power to prevent it, allowed such significant adverse effect to occur, unless the agency, after consultation with the Council, determines that circumstances justify granting such assistance despite the adverse effect created or permitted by the applicant. ”

“ In paragraph (13) strike “archaeology” and insert “prehistoric and historic archaeology, folklore, cultural anthropology, curation, conservation, and landscape architecture”. (12) Add at the end thereof the following new paragraphs: “ (14) ‘Tribal lands’ means— “ (A) all lands within the exterior boundaries of any Indian reservation; and “ (B) all dependent Indian communities. “ (15) ‘Certified local government’ means a local government whose local historic preservation program has been certified pursuant to section 101 (c) . ”

“ Purposes.—The purposes of the Center shall be to—
“ (1) develop and distribute preservation and conservation skills and technologies for the identification, evaluation, conservation, and interpretation of prehistoric and historic resources; “ (2) develop and facilitate training for Federal, State and local resource preservation professionals, cultural resource managers, maintenance personnel, and others working in the preservation field; “ (3) take steps to apply preservation technology benefits from ongoing research by other agencies and institutions ”
