Summary

Von Moltke v. Gillies — Dissent

Her status as an enemy alien does not, in itself, affect her right to counsel or the informed character of her plea of guilty and her waiver of counsel. The fact that the charge against her was under the Espionage Act and therefore carried a technical possibility of the death penalty did not at any time it roduce a practical consideration that she was in actual danger of suffering capital punishment.
