The treatment of speeches as unpublished works is much less amenable to simple guidelines like my proposal that "speeches be treated as any other literary work": however, I still feel that a treatment on the basis of 'who is the real author of the words' is the only way to go forward: I certainly do not believe that the mere fact of creating a transcription of a speech gives rise to a copyright. ”
