“ Extensive Rights of the People The Constitution stipulates that all power in the People's Republic of China belongs to the people, and that the people shall, in accordance with the provisions of the law, manage state affairs, economic and cultural undertakings, and social affairs through various channels and in various ways. China's political power is not linked in any way with personal status, wealth, or social relations, but is equally enjoyed by all the people. The state power serves the people, rather than capital. ”

“ In 1912, on the overthrow of the Manchu monarchy, China became a republic, with an elected President, and a Parliament consisting of a Senate and House of Representatives. The various government departments were reorganized on Western lines, and a large number of new offices instituted. Up to the present year the Law of the Constitution, owing to political dissension between the North and the South, has not been put into force.
Laws Chinese law, like primitive law generally, was not instituted in order to ensure justice between man and man ”

This instrument, like the Constitutional Compact, was wholly illegal and drawn up to make Yuan Shih-kai dictator for life.
THE PROVISIONAL CONSTITUTION OF THE REPUBLIC OF CHINA
Passed at Nanking in 1912, currently referred to as the old Constitution
CHAPTER I.—GENERAL PROVISIONS
Article 1. The Republic of China is composed of the Chinese people.
Art. 2. The sovereignty of the Chinese Republic is vested in the people. ”

“ The future of China is closely bound up with the future of the world. China pursues an independent foreign policy, observes the five principles of mutual respect for sovereignty and territorial integrity, mutual nonaggression, mutual noninterference in internal affairs, equality and mutual benefit, and peaceful coexistence, keeps to a path of peaceful development, follows a mutually beneficial strategy of opening up, works to develop diplomatic relations and economic and cultural exchanges with other countries, and promotes the building of a human community with a shared future. ”

“ PREAMBLE The National Government, in order to reconstruct the Republic of China on the basis of the Three Principles of the People and the Constitution of Five Powers, which forms the underlying principle of the revolution, having now brought the revolution from the military to the political tutelage period, deems it necessary to promulgate a Provisional Constitution for general observance, so that the realization of constitutional government may be accelerated and political power restored to a popularly-elected government ”

“ The habitation of any citizen of China shall not be entered or searched except in accordance with the law.
Art. 7. Citizens of China shall have the right of secrecy of their letters, except where otherwise provided by law.
Art. 8. Citizens of China shall have the liberty of choice of residence, and of freedom of trade; except according to law there shall be no restrictions thereof.
Art. 9. Citizens of China shall have the liberty to call meetings or organize societies, and no restriction shall be enforced except by law. ”

“ The grand justices of the Judicial Yuan shall, in addition to discharging their duties in accordance with Article 78 of the Constitution, form a Constitutional Court to adjudicate matters relating to the impeachment of the president or the vice president, and the dissolution of unconstitutional political parties.
A political party shall be considered unconstitutional if its goals or activities endanger the existence of the Republic of China or the nation's free and democratic constitutional order. ”

“ Article 116 Provincial rules and regulations that are in conflict with national laws shall be null and void. Article 117 When doubt arises as to whether or not there is a conflict between provincial rules or regulations and national laws, interpretation thereon shall be made by the Judicial Yuan. Article 118 The self-government of municipalities under the direct jurisdiction of the Executive Yuan shall be prescribed by law. Article 119 The local self-government of Mongolian Leagues and Banners shall be prescribed by law. Article 120 The self-government system of Tibet shall be safeguarded. ”
