Freedom of navigation

“ WHEREAS the United States continues to act in accordance with the balance of interests relating to traditional uses of the oceans recognizing freedom of navigation and overflight and other internationally recognized lawful uses of the sea ”

“ And it is provided that 'such navigable airspace shall be subject to a public right of freedom of interstate and foreign air navigation.' Id. It is, therefore, argued that since these flights were within the minimum safe altitudes of flight which had been prescribed, they were an exercise of the declared right of travel through the airspace. The United States concludes that when flights are made within the navigable airspace without any physical invasion of the property of the landowners, there has been no taking of property. ”

Accordingly, the first Congress assembled under the Constitution passed laws, requiring the masters of ships and vessels of the United States to be citizens of the United States, and established many rules for the government and regulation of officers and seamen. ”

“ To the contrary, we concluded, traditional admiralty concerns arise whenever the rules of navigation are implicated in a particular suit; a pleasure boat's failure to follow the "uniform rules of conduct" that govern navigation on navigable waters could have a "potential disruptive impact" on maritime commerce just as surely as could a similar transgression by a commercial vessel. ”

“ With compass and charts, sextant and chronometer, he could independently travel anywhere in the world. The increasing use of electronic navigation systems has made the navigator dependent on many factors outside his control. Government organizations fund, operate, and regulate satellites, Loran, and other electronic systems. Governments are increasingly involved in regulation of vessel movements through traffic control systems and regulated areas. Understanding the governmental role in supporting and regulating navigation is vitally important to the mariner. ”

“ Strict constructionists, like the advocates of the New York steamboat monopoly, "limit it to ... buying and selling ... and do not admit that it comprehends navigation." But why not navigation? "Commerce ... is traffic, but it is something more; it is intercourse." If this is not true, then the National Government can make no law concerning American vessels—"yet this power has been exercised from the commencement of the government, has been exercised with the consent of all, and has been understood by all to be a commercial regulation. All America understands ... ”

“ Resolved—That we will resist, by every legal and constitutional means in our power, the repeal of the navigation laws, so violently agitated by theorists and self-interested men, which were adopted, and have been sustained, by the wisest statesmen in all ages for the support of the shipping and seamen of Britain, to prevent the cheap ships and ill-fed and badly-paid foreigners from underselling and destroying the British mercantile marine. ”

“ It was simply to serve as an aid to navigation, and while it had not yet been finished and accepted, it was being erected under the constant supervision of a government inspector acting under the authority of the United States in the improvement and protection of navigation. ”

“ But it is as a resource of defence that our navigation will admit neither neglect nor forbearance. The position and circumstances of the United States leave them nothing to fear on their land-board, and nothing to desire beyond their present rights. But on their seaboard, they are open to injury, and they have there, too, a commerce which must be protected. This can only be done by possessing a respectable body of citizen-seamen, and of artists and establishments in readiness for ship-building. ”

“ We think not.
In the first place, the exception excludes from the operation of the act certain vessels, irrespective of the character of the navigation in which they are engaged, canal boats, barges, and lighters. These, from their very nature, cannot be used in ocean navigation, nor be exposed to its hazards.
Then there is excluded from the operation of the act, 'vessels of any description whatsoever used in rivers or inland navigation;' the phrase is sufficiently comprehensive to include everything that floats upon water, if used in the specified way. ”

“ Cases arise in navigation where a stubborn adherence to a general rule is a culpable fault, for the reason that every navigator ought to know that rules of navigation are ordained, not to promote collisions, but to save life and property by preventing such disasters. ”

“ It is when thus confined to that great highway and its concerns, that admiralty law deserves the just tribute sometimes paid to it of expansive wisdom and elevated equity. [1] , [2] Then only there is an excellence in such regulations as to navigation over those for rights and duties on land; the last being often more for a single people, and their limited territory, while the former are on most matters more expanded, more liberal,-the gathered wisdom of and for all maritime ages and nations. They are also what has been approved by all rather than a few, and for the territory of all in common. ”

“ But it is impossible for them to perform the duty of keeping out of the way, unless the sailing vessel is held to the correlative duty of keeping her course. Even-handed justice requires that the law of navigation should be as obligatory upon the sailing vessel as it is upon the steamboat. ”

“ Another circumstance which claims attention as directly affecting the very source of our navigation is the defect or the evasion of the law providing for the return of sea men, and particularly of those belonging to vessels sold abroad. ”

“ While the navigation laws of the United States are in many respects the most advanced and progressive of any in the world, the form in which they exist is far from satisfactory and is a serious handicap on their usefulness. ”
