John McKinley,  Lessee of Hickey v. Stewart — Opinion of the Court

“ In the view we have taken of the sufficiency of our defence in showing our right of possession, it is of course unnecessary to maintain that a decree of title, in legal consideration, is equivalent to a conveyance of title. Yet on principle, it must be so. A commissioner's deed, executed under a decree, is in itself form without substance. It has no force or validity, but in virtue of the decree. ”

John McKinley,  Pollard v. Hagan — Opinion of the Court

“ To give to the United States the right to transfer to a citizen the title to the shores and the soils under the navigable waters, would be placing in their hands a weapon which might be wielded greatly to the injury of state sovereignty, and deprive the states of the power to exercise a numerous and important class of police powers. But in the hands of the states this power can never be used so as to affect the exercise of any national right of eminent domain or jurisdiction with which the United States have been invested by the Constitution. ”

John McKinley,  United States v. Fitzgerald — Opinion of the Court

“ No law has been produced, to show that an officer of the United States is deprived of the benefit of the pre-emption laws; nor do we know of any law which deprives him of the right to acquire a portion of the public land, by any mode of purchase common to other citizens. Had this tract of land been severed from the public domain, by a legal appropriation of it, for any public purpose, Fitzgerald could have acquired no right to it by cultivation and possession; not because he was an officer of the United States, but because the land would not have been subject to the pre-emption law. ”
