Battle of Guilford Courthouse

“ Ordering the brave veteran Colonel Greene, with his Virginia regiment, to take post in the rear, and cover a retreat, the Americans withdrew in regular order, leaving their artillery behind, for almost every horse had been slain.
The 71st and 23d British regiments, supported by Tarleton's cavalry, commenced a pursuit; but Cornwallis, unwilling to risk such a movement, soon recalled them. * Thus ended the battle at Guilford Court House; a battle, in its effects highly beneficial to the cause of the patriots, though resulting in a nominal victory for the British army. ”

“ A summer ride which a party of us took to the battlefield of "Guilford-Old-Court-House" may be worth noting as an encouragement to believe that our descriptions of the scenes of our own engagements need not become unintelligible even in the distant future. Among the combats of our Revolutionary War, Guilford Court House ranks high in importance; for the check there given to the invading British army under Lord Cornwallis by the Continental forces under General Greene was the turning-point in a campaign. ”

“ As an offset to this loss the British troops captured the strongly fortified village of Guillemont and the German defenses on a front of one and two-third miles to an average depth of about 800 yards. The British took during this battle over 800 prisoners.
The new French positions to the north of Combles were violently attacked on this same date, but the German effort was broken by the machine-gun and artillery barrage. The French captured over 500 prisoners and ten machine guns. ”

For two and a half years you have endured the strain of hard service; much blood has been shed, great efforts have been made, and now the hour is at hand in which Russia and her glorious Allies will break the enemy’s last resistance in one common, mightier effort.
This unprecedented war must be carried through to final victory. Anyone who thinks of peace or desires it at this moment is a traitor to his country and would deliver her over to the foe. ”

“ The fact that the civil courts are open does not affect the right of the military tribunal to hold as a prisoner and to try. The civil courts have no more right to prevent the military, in time of war, from trying an offender against the laws of war than they have a right to interfere and prevent a battle. A battle may be lawfully fought in the very presence of the court; so a spy, a bandit, or other offender against the law of war, may be tried, and tried lawfully, when and where the civil courts are open and transacting business. ”

He disposed his army in three lines—the militia of North Carolina were in front; the second line was composed of those of Virginia ”

“ When the war was over the Supreme Court decided, in Milligan's case, [22] after the most solemn argument and deep consideration, that the President could not declare martial law in any district not invaded by the enemy and where the judges were on the bench and the courts of law in operation. Martial law exists where there is a battle. It exists in a community where war exists and the courts and civil authorities are overthrown. A commander at the head of his army may impose it on states in rebellion, to cripple their resources and quell the insurrection. ”

The Revolutionary War had begun, and the day after the battle of Lexington the Massachusetts Congress wrote to England: "We determine to die or be free." The news of the first bloodshed was rapidly carried from place to place by men on horseback. They went everywhere, calling the people to arms. Guns were polished and bullets cast, the women sacrificing even cherished pewter spoons and dishes to supply the necessary ammunition. ”

New Zealanders are on the extreme left, then the 87th Brigade, next the 88th and 86th, or what is left of it, with the new Territorial Lancashire Fusiliers. ”

“ The British Regulars holding the high ground along from Crowborough to Ticehurst, and from Etchingham, through Brightling and Ashburnham, down to Battle, advanced in a huge fighting line upon the enemy's base around Eastbourne. The onslaught was vigorously repelled, and the battle across the Sussex Downs quickly became a most wild and sanguinary one; but as the day passed, although the defenders were numerically very weak, they nevertheless gradually effected terrible slaughter, capturing the whole of the enemy's stores, and taking nearly five thousand prisoners. ”

“ We do not write on a clean slate. The attitude of a free society toward the jurisdiction of military tribunals-our reluctance to give them authority to try people for nonmilitary offenses-has a long history.
We reviewed both British and American history, touching on this point, in Reid v. Covert, 354 U.S. 1, 23-30, 77 S.Ct. 1222, 1233-1237, 1 L.Ed.2d 1148. We pointed out the great alarms sounded when James II authorized the trial of soldiers for nonmilitary crimes and the American protests that mounted when British courts-martial impinged on the domain of civil courts in this country. ”

“ But our mutiny act makes no such distinction: for any of the faults above-mentioned are, equally at all times, punishable with death itself, if a court martial shall think proper. This discretionary power of the court martial is indeed to be guided by the directions of the crown; which, with regard to military offences, has almost an absolute legislative power. “ Victims of the People’s Court, Special Courts, and civil courts martial were judicially murdered by certain of the defendants using a variety of legalistic artifices, all of which had the obvious common denominator of a zealous desire to exterminate even trifling activity not even deemed misdemeanors by the community of civilized nations. ”

“ An assault upon or an assassination of a judge of a United States court while engaged in any matter pertaining to his official duties, on account or by reason of his judicial decisions, or action in performing his official duties, is a breach of the peace, affecting the authority and interests of the United States, and within the jurisdiction and power of the marshal or his deputies to prevent as a peace officer of the National Government. Such an assault is not merely an assault upon the person of the judge as a man ”

“ On the contrary, that act authorizes the President to call forth the militia to suppress insurrections, and to enforce the laws of the United States, in times of peace. And Courts Martial are, under the 5th section of the act, entitled to take cognizance of, and to punish delinquencies in such cases, as well as in cases where the object is to repel invasion in times of war. ”
