Governor of Louisiana

“ All officers who hold their offices by the tenure of military appointment are subject to military authority and control, and will not be permitted to interfere in any manner whatever with the exercise of functions that have been committed to you as governor of Louisiana. ”

“ In November, 1762, France ceded the whole of Louisiana to Spain, but the people in New Orleans, who first heard of the transaction in 1764, strenuously objected to the change and forcibly expelled the first Spanish Governor, who came in 1766. In 1769 Alexander O'Reilly (q.v.) , who had just been appointed Governor of Louisiana, punished with unsparing severity those who had been prominent in the uprising. In the same year the census taken by Governor O'Reilly shows that the city possessed only 408 houses, with a population of 3191. ”

“ Plain and simple in my judgment is the proposition. I say to republicans, do not be scared. No man is ever hurt by doing an honest act and performing a patriotic duty. If we are to have a war of words outside or inside, let us have them in truth and soberness, but in earnest. What then is our duty? “ One historic clash in New Orleans (on the 14th of September 1874) between the “White League” (“White Man’s Party”) and the Republican police is commemorated by a monument, and the day is regarded by Louisianans as a sort of state independence-day. Finally, in 1876, Francis Tillon Nicholls (b. 1834) , a Democrat, was chosen governor, but the Republican candidate, S. B. Packard, claimed the election, and with a Republican legislature for a time occupied the State House. ”

“ The person having the greatest number of votes for Governor shall be declared duly elected; but if two or more persons shall be equal, and the highest in the number of votes polled for Governor, one of them shall immediately be chosen Governor, by joint vote of the members of the General Assembly. The person having the greatest number of votes for Lieutenant Governor shall be Lieutenant Governor ”

Many of the immigrants who now came to Louisiana were the royalist noblesse flying from the horrors of the French Revolution. Governor Carondelet was strengthening his fortifications around New Orleans; for Creole revolutionists had slipped away to Kentucky and were there plotting an armed descent in flatboats upon his little capital, where the rabble were singing the terrible songs of bloody Paris. ”

Sir: As I occupy a quasi-military position under the laws of the State, I deem it proper to acquaint you that I accepted such position when Louisiana was a State in the Union, and when the motto of this seminary was inserted in marble over the main door: "By the liberality of the General Government of the United States. The Union—esto perpetua."
Recent events foreshadow a great change, and it becomes all men to choose. ”

“ Every person shall be disqualified from serving as governor, Senator or Representative for the term for which be shall have been elected, who shall have been convicted of having given or offered any bribe to procure his election. ”

“ The governor shall appoint one member of the commission from the three persons nominated by each president. One member of the commission shall be elected by the classified employees of the state from their number as provided by law. A vacancy for any cause shall be filled by appointment or election in accordance with the procedure or law governing the original appointment or election, and from the same source. ”

“ Though no general election was held in response to this address, voting took place in two parishes, and certain persons were chosen as Representatives in Congress. Before giving an account of this election of November 2, 1863, it may be proper to notice a petition submitted by the free colored people of New Orleans to Governor Shepley praying to be registered as voters so that they could “assist in establishing in the new Convention a Civil Government” for their “beloved State of Louisiana.” ”

“ It is a fair question whether if the Italians, for example, should come to have a majority of votes in Louisiana they would ever be permitted to elect and inaugurate a governor out of their own number ”

“ Charles Dehault Delassus, lieutenant governor of upper Louisiana, whose deposition appears to be annexed to the report of the commissioners, deposes, 'that all the lieutenant governors of upper Louisiana were, in virtue of their offices as lieutenant governors, likewise sub-delegates. ”

“ Their societies marched with the others, and the races mingled on the grounds in unconscious equality of privileges. Speeches were made, glorifying the State and its history, by able speakers, the Governor among them; but it was the testimony of Democrats of undoubted Southern orthodoxy that the honors of the day were carried off by a colored clergyman, an educated man, who united eloquence with excellent good-sense, and who spoke as a citizen of Louisiana, proud of his native State, dwelling with richness of allusion upon its history. ”

“ If the legislature is not in regular session, the governor may make interim appointments, which shall expire at the end of the next regular session, unless submitted to and confirmed by the Senate during that session.
(4) A person not confirmed by the Senate shall not be appointed to the same office during any recess of the legislature.
(I) Removal Power. The governor may remove from office a person he appoints, except a person appointed for a term fixed by this constitution or by law. ”

“ Louisiana must be governed by Louisianians!”
The bubbling of the political caldron was at its hight. General Banks had removed Mr. Kennedy, the Mayor of the city. In turn, he had himself been superseded, and now it was rumored that the representations of his creature, the Governor, who had betrayed him, having been listened to at Washington, his humiliation was to be made complete by the restoration of Kennedy. 239Such was the reward already being reaped for the proscription of Durant, Flanders, and the other genuine Union men of the State, in the mongrel military reorganization. ”

“ Under the Territorial government the legislative officers were not at first elective. The “parishes” date from 1807; they were based on an earlier Spanish division for religious purposes—whence the names of saints in parish nomenclature. The constitution of 1812 allowed the General Assembly to name the governor from the two candidates receiving the highest number of votes; gave the governor large powers of appointment, even of local functionaries; and required a property qualification for various offices, and even for voters. ”

“ Each statewide elected official except the governor and lieutenant governor shall appoint a first assistant, subject to public confirmation by the Senate, and may remove him at his pleasure. The official shall submit the appointment to the Senate in the manner and subject to the procedures and limitations applicable to appointments submitted by the governor. ”

“ The revision or the proposed constitution and any alternative propositions agreed upon by the convention shall be submitted to the people for their ratification or rejection. If the proposal is approved by a majority of the electors voting thereon, the governor shall proclaim it to be the Constitution of Louisiana.
§3. Laws Effectuating Amendments Section 3. Whenever the legislature shall submit amendments to this constitution, it may at the same session enact laws to carry them into effect, to become operative when the proposed amendments have been ratified. ”

“ All civil officers, except the Governor and judges of the Supreme and District Courts, shall be removable by an address of a majority of the members of both houses, except those the removal of whom has been otherwise provided for by this Constitution. ”

“ Each board shall be composed of two members from each congressional district and one member from the state at large, appointed by the governor with consent of the Senate. The members shall serve overlapping terms of six years, following initial terms fixed by law.
(C) Vacancy. A vacancy occurring prior to the expiration of a term shall be filled for the remainder of the unexpired term by appointment by the governor, with consent of the Senate.

“ Who, then, had a right to "institute" a republican government for Louisiana? No human beings whatever but the people of Louisiana; not the strangers, not the slaves, but the manhood that knew its rights and dared to maintain them. ”

“ A case wherein every department of the State government has a disputed representation, and a State therefore furnishes to the Federal Government no internal political recognition of authority upon which the Federal Executive can rely, will present a case of so much difficulty that it is of pressing importance to all interests in Louisiana that it should be avoided. ”

“ If, on the contrary, they reorganize and sustain the new Government of Louisiana, the converse of all this is made true. We encourage the hearts and nerve the arms of twelve thousand men to adhere to their work and argue for it, and proselyte for it, and fight for it, and grow it, and ripen it to a complete success. The colored man, too, in seeing all united for him, is inspired with vigilance and with energy and daring to the same end. Grant that he desires the elective franchise. ”
