“ Should there be anyone carrying out whatever act to cause a computer system to fail to function in line with given directions or to function erroneously against the given directions, or wrongfully employing whatever method to obtain knowledge about, modify, or destroy another person's data in a computer system, or using a computer system to publish false or indecent computer data, then damage would ensue, affecting the economy, society, and security of the State, as well as public peace and good morals. ”

“ Section 16 Courts of first instance have territorial jurisdiction as determined by their constituent acts. In case of necessity to change the jurisdiction of a court for the benefit of the carriage of justice to the people, this shall be enacted as a royal decree. ”

“ When the position of presiding judge of a provincial court or presiding judge of a municipal court falls vacant, or when the holder of the said position becomes unable to carry out his official service, the most senior judge in such court shall act in such capacity. If the most senior person in the court is unable to carry out his official service, the judge next in line of seniority of that court shall act. In the event that there is no person to act in accordance with paragraph 2, the President of the Supreme Court of Justice may order a particular judge to act. ”

“ Unfavourable program, in paragraph 1, means a program which results in any computer data or computer system or another program being exposed to damage, to destruction, to modification, alteration, or supplementation, or to disruption, or operating in a manner contrary to given directions or in other manners as determined in ministerial regulations, save a program which is intended for the prevention or modification of the described program, as published in the Government Gazette by the Minister. ”

“ Section 26 Subject to section 25, as for the trial and adjudication of cases of a court of first instance other than a municipal court or another court of justice for which its constituent act determines otherwise, there must be at least two judges, amongst whom there must be no more than one junior judge, [8.2] to constitute a quorum with the power to try and adjudicate all civil cases or criminal cases. ”

“ Section 21 In case a competent authority finds that any computer data contains an unfavourable program, the competent authority may file an application with a competent court for an order prohibiting its disposal or publication or an order directing the owner or possessor of such computer data to terminate the use of, to destroy, or to modify the computer data, or may impose conditions governing the use, possession, or publication of the said unfavourable program. ”

“ Any service provider who provides cooperation to, consents to, or connives at the commission of any crime under section 14 within a computer system under his control shall be liable to the same punishment as the criminal under section 14. ”

“ But the former is translated as 'wilfully' and the latter, as 'intentionally', just for the sake of distinction and because they might have different meanings in legal context (though there has been no judicial decision about their difference yet) . ↑ The Thai sentence can also be separated as 'ผู้ให้บริการผู้ใดจงใจ, สนับสนุน, หรือยินยอมให้มีการกระทํา...', which can be translated as 'Any service provider who wilfully causes, aids, or consents to the commission...'. ”

“ In determining special compensation, regard must be had to the missions and duties, the knowledge and proficiency, the lack of functionaries or the loss of large numbers of functionaries from the government system, the qualities of work, and the maintenance of oneself in righteousness, with comparison to compensation for other functionaries in the process of justice as well. ”
