“ It recognized the doctrine that an implied or resulting trust arises by operation of law whenever one person buying and paying for an estate has the title placed in the name of another, but held that where the title is conveyed to a wife or child, or other person for whom the one paying the purchase money is under an obligation, legal or moral, to provide, no presumption of a trust arises, and that it is incumbent on one who claims the existence of such a trust to establish it by clear, positive, a d unequivocal proof, and that this had not been done in the present case. ”
