In our system of justice, "only the jury may strip a man of his liberty or his life." Irvin v. Dowd, 366 U.S., at 722, 81 S.Ct., at 1642.
Eight of the twelve jurors who voted to strip Dawud Majid Mu'Min of his life may well have been rendered incapable of reaching any other verdict after reading of the grisly accusations against Mu'Min and the succession of stories indicating that he was guilty. The majority holds that the trial court was entitled to seat those jurors-entirely blind to what they in fact already knew about the case-based solely upon their assertions of impartiality.
