Anthony Comstock

“ He was, in brief, more than the greatest Puritan gladiator of his time; he was the Copernicus of a quite new art and science, and he devised a technique and handed down a professional ethic that no rival has been able to better.
The whole story is naïvely told in "Anthony Comstock, Fighter," [48] a work which passed under the approving eye of the old war horse himself and is full of his characteristic pecksniffery. ”

“ It was then that he determined, after a severe attack of sclerosis, to consecrate the remainder of his life to the moral regeneration of the world. He became a reformer among reformers. Emulating the magnificent efforts of Anthony Comstock, after whom his grandson was named, he levelled a varied assortment of uppercuts and body-blows at liquor, literature, vice, art, patent medicines, and Sunday theatres. ”

“ It is correct in one sense to say that if the National Government has the power to act under the Necessary and Proper Clause then that power is not one reserved to the States. But the precepts of federalism embodied in the Constitution inform which powers are properly exercised by the National Government in the first place. ”

“ The phrase "rational basis" most often is employed to describe the standard for determining whether legislation that does not proscribe fundamental liberties nonetheless violates the Due Process Clause. ”

The Court relies on Sabri, supra, for its conclusion that a "means–ends rationality" is all that is required for a power to come within the Necessary and Proper Clause's reach. ”

“ Federal prisoners often lack a single home State to take charge of them due to their lengthy prison stays, so it is incumbent on the National Government to act. This obligation, parallel in some respects to duties defined in tort law, is not to put in motion a particular force (here an unstable and dangerous person) that endangers others. Having acted within its constitutional authority to detain the person, the National Government can acknowledge a duty to ensure that an abrupt end to the detention does not prejudice the States and their citizens. ”

“ The opinion of the Court should not be interpreted to hold that the only, or even the principal, constraints on the exercise of congressional power are the Constitution's express prohibitions. The Court's discussion of the Tenth Amendment invites the inference that restrictions flowing from the federal system are of no import when defining the limits of the National Government's power, as it proceeds by first asking whether the power is within the National Government's reach, and if so it discards federalism concerns entirely. ”

“ The man Comstock, who has the shameful distinction of having lent his name to the idea of which he is the willing and probably the fit exponent, may be dismissed without further consideration, since he is, after all, only the inevitable as he is the deplorable result of that for which he stands ”

It is not a case in which the National Government relieves the States of their own primary responsibility to enact laws and policies for the safety and wellbeing of their citizens. See United States v. Morrison, 529 U.S. 598 (2000) . Nor is it a case in which the exercise of national power intrudes upon functions and duties traditionally committed to the State. ”

“ There was no need of explanation. The eyes under the drooping frill grew joyous at the sight of the honored face. The heart under the coarse cotton frock beat high with pride, and—yes, shame, for how was the boy to make himself known?
"Pray be seated," the deep voice was saying. "You are weary and you have taken chances of danger to reach me with your gift."
Andy sank into the nearest chair.
"I appreciate your devotion and unselfishness, but I would advise no future attempts to pass the British lines for such a thing."
"There were other reasons, sir," said Andy. Washington came nearer. ”

“ The bulk of the Comstocks' business was always carried on in rural areas—in "the back-woods." Specifically, the best sales territory consisted of the Middle West—what was then regarded as "The West"—of the United States and of Canada West, i.e., the present province of Ontario. A surviving ledger of all of the customers of Comstock & Brother in 1857 supplies a complete geographic distribution. ”

“ As a matter of fact before he quite knew how he had covered the distance between the house and Puritan Square, he was there.
The streets were crowded with people but of a lovely red-haired siren there was no sign, no sign at all.
CHAPTER 9
A wave of revulsion turned Comstock's stomach making him forget, for a moment, the girl for whom he was seeking. All around him in eddying mobs were elderly, grey and white-haired women, their long dresses dragging on the ground. The idea that he had ever found them exciting was hard for him to bear. ”

“ Comstock is an earnest, sincere, enthusiastic writer; she is an educated woman, a suffragist, with experience in public speaking and a familiarity with public affairs; she is a homemaker who has always made the keeping of a pleasant home in Flatbush, Brooklyn, her chief business and who wrote at first just for fun and as she had the chance; she has convictions and no more hesitates to act upon them than to express them; she is personally modest—you have to dig things out of her about herself. ”

“ Here, Andy, lad, give me your hand. To the house, and to bed. Ere daybreak I must be well away from here. They are planning an attack at once, and I know where I can get the plans, methinks. That fellow saw you, and there is no further chance for me here."
"You—you are going?" Andy, leaning on the master and his crutch, was making good headway. "The man saw only me; surely you can stay in safety."
"Andy, do you think the fellow thought you dealt that blow?" The clear laugh was stifled. "No; we are marked men. But I am on the right course now. Washington shall soon have the papers he needs." ”

“ All of the Comstock brothers, with the exception perhaps of Lucius, seem to have traveled a large part of their time, covering the country from the Maritime Provinces to the Mississippi Valley, and from Ontario—or Canada West—to the Gulf. Their letters to the "home office" show that they were frequently absent for extended periods, visiting points which at the very dawn of the railroad era, in the 1840s and 1850s, must have been remote indeed. ”

“ Andy, they look—they look magnificent!" Ruth was quivering on her perch. Janie flung prudence and dignity to the winds, and climbed to Ruth's side, and, being taller, gained a portion of the crack above the girl's head.
"I can see no one but the General!" she said. "The crack is over-narrow for such doings!"
"There is no one but Washington!" breathed Andy, and he lifted his head proudly.
"Yes, there are others," whispered Ruth, misunderstanding, "and if you run your eye up and down the crack quickly, you can catch a sight of them. The crack is wider in some parts." ”

“ The darkness was so intense that it was something of a shock to the master when he suddenly became aware that he could see the outline of his guide's body. There was a small opening ahead, and a gleam of moonlight shot in! Neither spoke. If the British sentry was beyond there was every need of stillness now.
"I hear steps!" said Andy in a breath; "listen!"
The duller ear of the master heard no sound for a moment, then slowly and alarmingly near, he did catch the sound of the measured tread of a soldier, and, from the opposite direction evidently, a second man. ”

“ All that I can say with any assurance, is that if something is not done and done quickly, our world will go down the road to static death, never knowing what has toppled it from the high estate it held."
Comstock's mind was almost incapable of digesting what The Grandfather was saying. It had all happened much too quickly. To be raised in a matter of moments from a position where death seemed imminent first to a position on the Board of Fathers, and now, if he understood correctly, to be told that the future of the world was somehow his responsibility, was just too much. ”

“ On they went, sometimes creeping under the hanging rocks, always clinging to the shelter of trees and bushes. They both knew the danger that might lie near in the form of a British sentinel.
"The path seems untrodden by foot of man," murmured the stranger, pausing to draw in a long breath. "You are a wonderful guide."
"I think no one else knows the way," Andy whispered, proudly; "an Indian showed it to me when I was a child. He was my good friend, he taught me also to row, and shoot with both arrow and gun. He said I should know Indian tricks because of my lameness. ”

“ Andy's path must not be discovered! She must do her part.
"Good-day, my pretty lass!" The man halted. Under ordinary circumstances Ruth would have taken to her fleet feet at this, but Andy might return too soon, and emerge while yet the enemy could discover him.
"Berrying?" grinned the fellow; "August is early for berries, is it not? The man was suspicious, perhaps, and Ruth was on guard.
"For some kinds," she answered, lightly.
"What kind are you hunting?"
"One that you British do not know," she replied; "it's a kind that grows only in America and thrives upon freedom." ”

“ We need you, so do not leave the hive." From hive to hive she went, quite seriously repeating the sentence in soft murmurings. Andy stood and looked, the moonlight showing him pale and intent. At last the deed was done, and Ruth came back to him and laid her firm, brown hand upon his shoulder. She was a trifle taller than he, so she bent to speak.
"Not even your mother knows you as I do, Andy," she said. "She thinks a lame leg can cripple a brave soul; but it cannot! Why, even being a girl could not keep me back if I saw my chance, and I tell you, Andy, your lameness may serve you well. ”

“ In the meanwhile, the elder Comstock had become one of the most prominent citizens of Brockville, which he served three terms as mayor and once represented in the Canadian parliament. Besides his medicine factories on both sides of the river, he was active in other business and civic organizations, helped to promote the Brockville, Westport & Northwestern Railway, and was highly regarded as a philanthropist. Although he lived well into the automobile age, he always preferred his carriage, and acquired a reputation as a connoisseur and breeder of horses. ”

“ This should mean the young rebel's death!"
"He's a spy in the old fox's hire!" shouted another.
"String him up, along with the schoolmaster down at the Beekman place to-morrow morning!" roared a third. All was wild commotion in a moment. But in that moment Andy took his chances and made for the thicket, and the hidden path over which he and Washington went that day that now seemed so long ago. A man leaned from a horse and tried to clutch him, lost his balance and tumbled to the ground. Confusion covered Andy's dash. ”

“ Not knowing what a philosopher might be did not prevent her from feeling sorry that the bound man had been the last of whatever it was that he had been.
Comstock never knew about the conversation that the quondam Picaroon had with Pat, for all the while that the girl and the bound man talked, Comstock was in a little world of his own trying to chase down the reality of his own existence.
Sitting on the ground next to the man who called himself the Picaroon and the last philosopher, Pat found herself involved in a discussion of what the man spoke of as the eternal verities. ”

“ Jogging along at his beloved's side at a half-run, half-walk, Comstock wondered if even death could eradicate the exultation which he felt. But feeling as he did was not conducive, he found, to gloomy, dismal thoughts.
Not even when they ducked down a long alleyway, which he thought led in the general direction of Bowdler's house, did he really, deeply feel concerned about capture. Life could not be so unfair, he decided, as to raise him up to such heights as he had just surmounted, and then drop him into a gloomy pit. ”

“ Comstock's shoulder. Lower drooped the gay wings, wider they spread, brighter grew the markings as if laid off in geometrical patterns. They could hear Mrs. Comstock's tense breath and see her absorbed expression.
"Young people," she said solemnly, "if your studying science and the elements has ever led you to feel that things just happen, kind of evolve by chance, as it were, this sight will be good for you. Maybe earth and air accumulate, but it takes the wisdom of the Almighty God to devise the wing of a moth. If there ever was a miracle, this whole process is one. ”

“ The soldier was the one who had accosted Ruth; Andy knew him at once.
"Dear me! dear me!" cried the master, querulously, "after seeing us pass to and fro so often, one would not think it necessary to resort to such rudeness. Pray, good fellow, is not this his Majesty's highway, and free to all?"
"No," grumbled the sentinel, lowering his weapon; "what's your business?"
"Schoolmaster."
"I do not mean that. I see you prodding around rocks and weeds with your noses in books, but I want to know what you mean on this road?"
"I desire to take a walk on it. I have no weapon, I am a peaceful person. ”
