Trade law

Definition and stakes

Joseph P. Bradley,  Hamilton v. Dillin — Opinion of the Court

“ To provide the 'rules and regulations' for conducting a trade relates to the conduct of the persons engaged in it, their methods of transacting their business, the imposition of such checks and safeguards as will secure a compliance with the law. To make such trade contribute in any essential form to the revenues of the country is the exercise of one of the highest prerogatives of the government, and is to be determined upon grounds widely different from the supervision and policing of the trade itself. ”

Various,  The Century Illustrated Monthly Magazine…

“ The most sensible and scientific tariff law which the United States could have,—allowing that the principle of tariff for revenue and protection is to prevail,—is such rate of duty as may be deemed advisable, all things considered; an arrangement whereby a surtax could be imposed upon goods from countries discriminating against American merchandise, and a trading margin for treaty-making purposes, ranging from the normal rate of duty, as [Pg 893] set forth in the customs laws, to absolute free trade between the treaty-making powers. ”

George Ticknor Curtis,  History of the Origin, Formation…

“ One State had granted full powers to regulate its trade, by restrictions or duties, for fifteen years, with a proviso that the law should be suspended until all the other States had done the same. [291] Another State had granted power, for twenty-five years, to regulate trade between the respective States, and to prohibit or regulate the importation only of foreign goods in foreign vessels, but restricting the operation of the act until the other States had passed similar laws. ”
