Legislative Council of Hong Kong Food Safety Ordinance (2011)

In determining, for the purposes of the definition of “food distribution business” in subsection (1) , whether the principal activity of a business is the supply of food in Hong Kong by wholesale, regard must be had only to those activities of the business that are related to the supply of food.
3. Food not intended for human consumption
(1) This Ordinance does not apply in relation to any food that is not intended for human consumption.

A person on whom a notice has been served under subsection (1) commits an offence if the person—
(a) fails to comply with the notice; or (b) in purported compliance with the notice— (i) provides information that the person knows is false in a material particular; or (ii) recklessly provides information that is false in a material particular.

A person bound by a food safety order who contravenes a term of the order commits an offence and is liable to a fine at level 6 and to imprisonment for 12 months.
(2) It is not a defence for the person to show that the food concerned is the subject of a licence, permit or any other form of authorization issued or granted under this or any other Ordinance.
