“ Even if we were of opinion that the act of congress was not in harmony with the constitution, every presumption was in favor of its validity; and we cannot assent to the proposition that it would have been competent for the commissioner to treat the original decree as absolutely void, and without force and effect as to all persons and for all purposes.But as, in our opinion, the court of appeals had jurisdiction, we prefer to affirm the judgment on that ground. ”
