“ It is therefore worth while to notice the most important provisions of the law of establishment, which was to serve as a foundation for the audiencia during a period of approximately three hundred years. The first thirty-eight sections were devoted to the creation of the tribunal, to a definition of its jurisdiction over civil and criminal cases, and to a determination of the proper method of procedure in them. The audiencia was to have authority to try cases of appeal from gobernadores, alcaldes mayores, and other magistrates of the provinces ”

“ The tendency to fill offices with friends and relatives was characteristic not only of the magistrates, but of the viceroys and governors as well. More laws are to be found in the Recopilación which guard against such abuses by governors and viceroys than by the magistrates of the audiencia.52 Bearing in mind, of course, that there are two sides to the question, it is at least clear that the audiencia was successful in one of the purposes for which it was created—namely, that of preventing the governor from exercising entire control over appointments. ”
