Treaty of New Echota

“ Balfour stated at the Washington Conference, it was necessary to "annul, merge, destroy, as it were, this ancient and outward and unnecessary agreement, and replace it by something new, something effective, which should embrace all the powers concerned in the vast area of the Pacific." By the Four Power Treaty the Anglo-Japanese Alliance was automatically discontinued, and Great Britain, the United States, France, and Japan became associated in friendly partnership as guardians of the peace in the Far East. ”

“ There is something, too, which shocks the conscience, in the idea that a treaty can be put forth as embodying the terms of an arrangement with a foreign power or an Indian tribe, a material provision of which is unknown to one of the contracting parties, and is kept in the background, to be used by the other only when the exigencies of a particular case may demand it. ”

“ After the Constitution’s ratification, the new Federal Government exercised its enumerated powers with regard to Indian tribes. To start, the Government embarked on an era of treaty-making with Indian tribes. See Cohen §1.03 [1] , at 23. That treaty-focused policy reflected the Washington administration’s view that Indian tribes were best dealt with as mostly “foreign nations,” with an eye towards peace lest frontier conflicts continue to plague the new Nation. ”

“ The parties on the face of the treaty are the United States and the Creek Nation, and however desirous one of them may be to give it effect, this wish must prove abortive while the other party refuses to perform its stipulations and disavows its obligations. By the refusal of the Creek Nation to perform their part of the treaty the United States are absolved from all its engagements on their part, and the alternative left them is either to resort to measures of war to secure by force the advantages stipulated to them in the treaty or to attempt the adjustment of the interest by a new compact. ”

“ It should be further remarked that the suppression of the clause excluding the establishment of settlements in Manchuria is desired because it conflicts with stipulations of the new Commercial Treaty between Japan and China. In this respect, however, Japan will be satisfied if she receives equal treatment with another Power which has already acquired similar rights in regard to settlements in Manchuria. ”

“ With the Mikado's sanction of the treaties of 1858–1861, it no longer became the patriotic duty of loyal Japanese to strive for the expulsion and extermination of the foreigners. For the first time in seven years, foreign affairs were divorced from domestic politics. On the one hand, all Japanese were free to take advantage of the material and moral contributions of the West, and on the other the treaty powers were freed from a dangerous dependence upon the Shogunate. ”

“ If the Indians intended, so far as they were concerned, to pass an absolute unencumbered title to the United States, it would, we think, have been impossible to employ language more appropriate to that object than is to be found in the treaty of 1866. Our convictions upon this point are so decided that we feel constrained to say that if some of the parties had not been Indians it would never have occurred to anyone that the cession of territory made by that treaty was attended by conditions in the nature of a trust. ”

“ After mature reflection, I am of opinion that military posts ought to be established and kept up within the Indian territory, in such positions as to maintain peace among the Indians, and protect the emigrant and feebler tribes against the stronger and more warlike nations that surround them; which the United States are bound to do by treaty stipulations. To withdraw those which now exist there, would be to violate our faith, as there is reason to apprehend that it would be the signal of war. ”

“ If a peace can be established with the said Indians on reasonable terms, the interests of the United States dictate that it should be effected as soon as possible.
You will therefore inform the said Indians of the dispositions of the General Government on this subject and of their reasonable desire that there should be a cessation of hostilities as a prelude to a treaty. ”

“ Resolved, That we would be rejoiced at the assurance of peace with Mexico, founded on the just principles of indemnity for the past and security for the future; but that while the ratification of the liberal treaty offered to Mexico remains in doubt, it is the duty of the country to sustain the administration and to sustain the country in every measure necessary to provide for the vigorous prosecution of the war, should that treaty be rejected. ”

“ One country, the United States, which had always been Japan's kindest patron, did, no doubt, show signs of breaking away from the league of the Western powers, and made a separate treaty in 1876, whereby all the chief points in dispute were surrendered. This treaty, however, contained one clause which invalidated all the rest,—a clause to the effect that the treaty was not to go into force until all the other powers should have concluded treaties of a similar purport. America's good-will on this occasion, though doubtless genuine, proved therefore to be of the Platonic order ”

“ In order that a nation may have a footing for entering into treaty relations with one sovereign power, it must be equally free, unless it waives the right, to make treaties with other like powers. Now it would be no unfair teat of what we conceive to be the nature of our treaties with our Indian tribes, to ask how we should feel and what we should do, if those red sovereigns entered into similar covenants, say, with Great Britain, France, or Russia. ”

“ Political treaties, the purposes of which is usually to terminate wars, establish boundaries, award indemnities, etc., naturally belong, as a rule, to the first class, while commercial treaties usually have a time limit. This accounts for a good many of the blank spaces in the above synopsis.
It will be noticed that there are some countries in the above list which have not at present the treaty making power—such, for instance, as Egypt, the Hanseatic Republic, Prussia, Hawaii, Samoa, Madagascar, Borneo, Kongo Free State, etc. ”

“ Yet we hear of no claim of jurisdiction set up by those states over these Indians. This treaty, both in form and substance purports to be an arrangement with an independent sovereign power. It even purports to be articles of confederation. It contains stipulations relative to peace and war, and for permission to the United States troops to pass through the country of the Delaware nation. That neither party shall protect in their respective states, servants, slaves, or criminals, fugitives from the other; but secure, and deliver them up. Trade is regulated between the parties. ”

“ But the Constitution that followed reflected an understanding that Tribes enjoy a power to rule themselves that no other governmental body—state or federal—may usurp.
Several constitutional provisions prove the point. One sure tell is the federal government’s treaty power. See Art. II, §2, cl. 2. Because the United States “adopted and sanctioned the previous treaties with the Indian nations, [it] consequently admit [ted the Tribes’] rank among those powers who are capable of making treaties.” Worcester, 6 Pet., at 559. ”

“ But it should be also carefully noted that this 1868 treaty recognizes unreservedly the Queen as Sovereign of Madagascar, makes no admission of, or allusion to, any of these alleged French rights, much less any protectorate; and is simply a treaty of friendship and commerce between two nations, standing, as far as power to make treaties is concerned, on an equal footing. If French statesmen, therefore, are sincere in saying that they only require the maintenance of the treaty of 1868 in its integrity, the difficulties between the two nations will soon be at an end. ”

“ The United States agrees that the agent for said Indians shall in the future make his home at the agency building on the Shoshonee reservation, but shall direct and supervise affairs on the Bannack reservation; and shall keep an office open at all times for the purpose of prompt and diligent inquiry into such matters of complaint by and against the Indians as may be presented for investigation under the provisions of their treaty stipulations, as also for the faithful discharge of other duties enjoined by law. ”

“ The United States of America, the British Empire, France and Japan have through their respective Plenipotentiaries, agreed upon the following stipulations supplementary to the Quadruple Treaty signed at Washington on December 13, 1921:
The term "insular possessions and insular dominions" used in the aforesaid Treaty shall, in its application to Japan, include only Karafuto (or the Southern portion of the island of Sakhalin) , Formosa and the Pescadores, and the islands under the mandate of Japan. ”

“ So far as concerns the relationship between our country and Japan, the transcendent importance of this treaty has been to supersede and overshadow all these minor [230] matters that before were continually menacing our good relations. By the reservations prepared by the American delegates, and accepted by the other powers, it is provided that the treaty "shall not be taken to embrace questions which according to principles of international law lie exclusively within the domestic jurisdiction of the respective powers." ”

“ Under our system of government, treaties occupy a unique position. They are not only binding internationally, but the Constitution makes treaties a part of the supreme law of the land—that is, a part of our own municipal law. A treaty, if of later date, and in conflict with a law passed by Congress, repeals so much of the law as it conflicts with; but an unratified protocol, or any other international agreement, no matter by what name it is called, not submitted to the Senate, does not have the effect of a treaty, as that term is defined in the Constitution. ”

“ The professed objects of both the treaties are to open communications across the Isthmus to all nations and to invite their guaranties on the same terms. Neither of them proposes to guarantee territory to a foreign nation in which the United States will not have a common interest with that nation. Neither of them constitutes an alliance for any political object, but for a purely commercial purpose, in which all the navigating nations of the world have a common interest. Nicaragua, like New Granada, is a power which will not excite the jealousy of any nation. ”
