“ Model codes can advance these goals in various ways, such as serving as industry best practice benchmarks for designers and builders; voluntary compliance programs for sustainability, energy efficiency, and disaster resistance; and assisting with credentialing and certification of building and construction industry participants and products.
Of particular relevance here, one way that ICC advances its goals is through the adoption of its model codes into law. The record substantially reflects that one of ICC’s foremost reasons for developing model codes is for governments to enact them as law. ”

“ Notwithstanding any other provision of this section, any model building code or standard established under section 304shall not be binding on a State, local government, or Indian tribe as a matter of Federal law..

“ Technical codes and standards have become necessary, pervasive, and indispensable ingredients of Twenty-First Century life in this country; regrettably, today's majority opinion has a real potential of drastically changing the societal landscape through that opinion's predictably deleterious effects on these codes and standards, their authors, and the public and private entities that daily use and depend on them. ”

“ Each building constructed or altered by the Postal Service shall be constructed or altered only after consideration of all requirements (other than procedural requirements) of zoning laws, land use laws, and applicable environmental laws of a State or subdivision of a State which would apply to the building if it were not a building constructed or altered by an establishment of the Government of the United States. ”

“ Works involving addition or replacement of a building services installation specified in a code of practice that covers one or more places with a floor area or total floor area of not less than 500 m2 under the same series of works within 12 months in a unit or a common area of a prescribed building. ”

Because model codes are drafted by groups familiar with the particular subject matter of their codes, governmental adoption of model codes also helps align the law with industry best practices. ”

Some cities impose an absolute height limit beyond which no building of whatever class of construction can be erected. ”

“ Revision of model building energy codes– If the provisions of the IECC or ASHRAE Standard 90.1 regarding building energy use are revised, the Secretary shall make a preliminary determination not later than 90 days after the date of the revision, and a final determination not later than 15 months after the date of the revision, on whether or not the revision will—
(A) improve energy efficiency in buildings compared to the existing model building energy code; and (B) meet the applicable targets under subsection (b) (2) . ”

“ On Monday, May 23d, the Conference of the Building Trades met and modified the platform of principles which had been adopted May 19th. The principle change was in eliminating the clause requiring employes to sign the code of principles, and making it necessary only for them to "assent to" them. The platform as amended was as follows:

“ The new buildings may be constructed with modern materials and are required to be constructed in accordance with present day local laws, building codes, and reasonable prevailing standards in the area for similar facilities. If the owning agency has suitable land on which the new facility can be constructed, payment may be made for the land taken for highway purposes. “ These by-laws are an expense to ratepayers, and they increase the cost of buildings. Elaborate plans and descriptions have to be furnished, and the buildings have to be inspected at various periods of their construction, and, of course, all variations of plan which may appear necessary in the course of construction must also be submitted and 'passed' by the local authority. It may happen that there are members of the local council who understand the technicalities of the building trade ”

“ These model byelaws are too extensive to give in detail, as they contain 99 clauses, but every town surveyor should at once procure a copy, even if his corporation have not adopted them, nor intend to do so.
One of the first difficulties that often presents itself to [208] those who have to enforce the observance of the necessary “giving of notices and deposit of plans and sections by persons intending to construct new buildings” is to prove that the building is “new” so as to bring it under the operations of the Act. ”

“ I should like further, to ask you to publish to the New York City public, the fact that the "Department", the "Health Department", with its Bureau of Plumbing and Light and Ventilation, and the Building Bureau of the Fire Department, are unable to protect property owners and purchasers from errors in sanitation and construction as they are supposed by too many to do. Owners frequently think that unless they want "fancy" drawings and fronts, an architect is superfluous. ”

“ The use of many of these convenient and sound forms of building construction for ordinary buildings in London, and in districts of England where the model by-laws are in force, is prohibited because they do not comply with some one or other of the various clauses relating to materials, or to the thickness of a wall. ”

“ Where it appears to any local authority by the report of their surveyor that any house is used or intended to be used as a factory or building in which persons of both sexes are employed or intended to be employed at one time in any manufacture, trade, or business, the local authority may, if they think fit, by written notice require the owner or occupier of such house, within the time therein specified, to construct a sufficient number of waterclosets, earthclosets, or privies and ashpits for the separate use of each sex. ”

“ Each Federal agency responsible for the construction and lease of a new building for Federal use shall ensure that the building is designed and constructed in accord with appropriate seismic design and construction standards. ”

“ Fortunately this task received the intelligent guidance of a citizens’ committee composed of local builders, architects and engineers. The building regulations were rescued from their contradictions and confusion, and a clear, systematic ordinance was secured. The most notable forward step was the authorization of reinforced concrete buildings. "Architects and engineers interested in the problems of reconstruction organized a ‘Structural Association’ as a clearing-house for improved building methods. ”

“ It can be intended for no other purpose than to characterize the use of the building at the date of the insurance; for, unless this be done, there can be no restriction on the use of the property by the insured, during the running of the risk. Unless this description has the force thus attributed to it, the premises could have been used for any of the most hazardous purposes. A building described in a policy as a 'dwelling house' could, except for the rule above stated, be converted into a mill or a factory. ”

“ The property management service enterprise or otherwise a manager shall, as entrusted by the unit owners, manage the buildings and their auxiliary facilities within the construction zone in accordance with the provisions of Book Three of this Code relating to contracts for property management service, subject itself to the supervision of the unit owners, and respond to the unit owners’ inquiries about property management services in a timely manner. ”
