Transgender and queer youth. The term transgender is a broad term that covers various groups. It can include transsexuals, cross-dressers, drag queens, people who are intersex (people born with both male and female genitals) , and straight people. Being transgender is not necessarily a reflection of sexual orientation. All transsexuals are transgender, but not all transgender people are transsexual. ”

“ Moreover, the retired Director of Student Services acknowledged that for a transgender student who has made the social transition and whose appearance is consistent with his or her gender identity (for example, a transgender girl whose hair is long, whose breasts are enhanced, who is wearing lipstick) , there may be safety, security, and privacy concerns if that student used the restroom that is consistent with the sex the student was assigned at birth; thus, she thought it would be preferable if such a student used a gender-neutral single-stall bathroom. ”

“ Diane Ehrensaft, a developmental and clinical psychologist who studies and specializes in treating transgender children and adolescents, there are a number of components that determine a person’s gender: external genitalia, internal sex organs, chromosomal sex, gonadal sex, fetal hormonal sex, hypothalamic sex, pubertal hormonal sex, neurological sex, and gender identity and role. ”

“ Non-transgender lesbian, gay and bisexual persons will have to recognise that questioning the meaning of sex, and challenging rigid gender roles, are in fact two sides of the same coin. Transgender issues therefore should be considered as part and parcel of our common struggle for equality and dignity.

“ Transgender students typically seek privacy and discreteness in restroom use and try to avoid exposing any parts of their genitalia that would reveal sex characteristics inconsistent with their gender identity. ”

“ The bathroom policy creates two groups—students who can use the boys’ bathroom and students who can use the girls’ bathroom. Both groups contain transgender students and non-transgender students, so a “lack of identity” exists between the policy and transgender status. Geduldig, 417 U.S. at 496 n.20.
At most, the policy has a disparate impact on transgender students, which is not enough to create a sex-based classification. Facially neutral policies trigger intermediate scrutiny only if “invidious gender-based discrimination” motivated them. ”

“ Putting these concepts together, Adams is a transgender boy because his gender identity—male—is different from his birth-assigned sex—female. When a person is not transgender, meaning his or her birth-assigned sex and gender identity align, that person is “cisgender.” ”

The decision to resolve the purported ambiguity as applied to transgender students with Price Waterhouse and Glenn fares no better. Like the majority, the district court erred by assuming that “sex” could have different meanings as applied to transgender and non-transgender persons. ”

“ The Endocrine Society Clinical Practice Guideline considers the standard of care for some adults and adolescents with gender dysphoria or who seek gender affirmance to include hormone treatment which, for a transgender male, will alter the appearance of the genitals, suppress menstruation, and produce secondary sex characteristics such as increased muscle mass, increased body hair on the face, chest, and abdomen, and a deepening of the voice. ”

This famous first sentence of the Universal Declaration of Human Rights, adopted almost sixty years ago by the General Assembly of the United Nations, still contains in a nutshell our political agenda, as lesbian, gay, bisexual, transgender, transsexual, transitioned and intersexual persons. ”
