“ Without belaboring the point, intersex students do exist; they have or can develop unexpected genitalia. Biological females may still have male genitalia in the female restroom, and vice versa. A sex-assigned-at-matriculation bathroom policy cannot prevent that phenomenon. The case of intersex students therefore proves that a privacy concern rooted in a thin conception of biological sex is untenable. ”

Instead of grappling with the meaning of “sex,” the majority abdicates its duty to interpret the law. “ Adams who properly tees up the constitutional issue in this case. The School Board’s bathroom policy singles out transgender students for differential treatment because they are transgender: “Transgender students will be given access to a gender-neutral restroom and will not be required to use the restroom corresponding to their biological sex.” The policy emphasized the School Board’s position that no law required it to “allow a transgender student access to the restroom corresponding to their consistently asserted [] gender identity.” ”

“ Adams, Nease High School administrators were acting to enforce the School District’s unwritten bathroom policy. For “as long as anybody can remember,” the School District has maintained a policy that, for restroom use, “boys go to boys’ rooms, [and] girls go to girls’ rooms.” But school administrators came to enforce the unwritten bathroom policy against Mr. Adams in September 2015, when he was directed not to use the boys’ bathroom. That unwritten policy assigns students to use bathrooms based solely on the sex indicated on a student’s enrollment documents. ”

“ Adams to single-stall, gender-neutral bathrooms and exposed him to school discipline for using the restroom matching his gender identity. These hardships were imposed on Mr. Adams because he is transgender and did not act or present as female, the sex he was assigned at birth.
The gender stereotypes the School Board imposed on Mr. Adams track the stereotypes this Court ruled unconstitutional in Glenn. Vandiver Elizabeth Glenn, a transgender woman, was fired because her employer perceived her as “a man dressed as a woman and made up as a woman.” ”

Every ward in the hospital has a bathroom attached to it, but in addition to these there are two large bathrooms, each containing a number of baths, which are used by walking patients and also by the orderlies. The more recently built of these bathrooms is divided into private cubicles. In the older one the baths are on a more sociable plan, with no partition walls sundering them. The spectacle, in the "old" bathroom, when a convoy of walking cases has arrived, is one which should appeal to a painter. ”
