A person who is employed by or under contract with a private inspection facility and who affixes a certificate of approval or a waiver certificate to a motor vehicle without having properly inspected the vehicle or without having determined that the condition of the vehicle conforms to standards established by law or regulation shall be liable to a civil penalty of not less than $500, to be collected in a civil action commenced by the director.

A person shall not conduct any emission inspection required by the director on a motor vehicle unless that person is licensed as an emission inspector by the director. The director may establish a fee not to exceed $50 for the licensure and relicensure of emission inspectors and shall establish standards and requirements for the licensure and relicensure of emission inspectors including, at a minimum, the successful completion of emission training and testing requirements determined by the director in consultation with the Department of Environmental Protection as a prerequisite to licensing.
