“ Every applicant for examination must be a citizen of the United States, must be of proper age, and must make an application under oath upon a form prescribed by the Commission and accompanied by such certificates as may be prescribed. ”

“ No applicant for competitive examination, or eligible on any civil service register, or officer or employee in the executive civil service, shall directly or indirectly persuade, induce, or coerce, or attempt to persuade, induce, or coerce any prospective applicant, applicant, or eligible to withhold filing application or to withdraw from competition or eligibility for positions in the competitive classifted civil service, for the purpose of either improving or injuring the prospects or chances of any such applicant or eligible. ”

“ Unless otherwise ordered by the appellate division, no person shall be admitted to practice without a certificate from the proper committee that it has carefully investigated the character and fitness of the applicant and that, in such respects, he is entitled to admission. ”

“ Provision is made for submission by the applicant to the Committee of 'all the information and data required by the committee and the Appellate Division justices.' Ibid. If an applicant has once applied for admission and failed to obtain a certificate of good character and fitness, he must obtain and submit 'the written consent' of the Appellate Division to a renewal of his application. ”

“ Afterwards the applicant was informed by the president of the board that his short business-like letters, written in an almost illegible but natural hand, obtained for him the place over nearly one hundred applicants, many of whom were college graduates of long experience in teaching, and who had basketfuls of testimonials, but not one of whom had written even a fairly good letter of application.
Many cities and towns have stated public examinations, which applicants must attend before they can be employed. ”

“ Upon timely application anyone shall be permitted to intervene in an action: * * * (2) when the representation of the applicant's interest by existing parties is or may be inadequate and the applicant is or may be bound by a judgment in the action ”

“ We do not think that it is. Section 2290, it is true, does not provide that the affidavit of the applicant shall set forth whether there has been a previous entry. Neither does it provide that the applicant shall state that he is a citizen, or has filed his declaration of intention to become such Yet, under § 2289, he cannot make entry unless this qualification exists. We are concerned with positive requirements of the law, which are to be enforced by the Department. ”

“ Every application must be accompanied by a certificate, signed by not less than three nor more than five reputable citizens, stating the time for which each has been acquainted with the applicant, and testifying to his good character and reputation for integrity, sobriety, and industry, and to the willingness of the signers to furnish personally any further information they may possess concerning the applicant, if so requested by the postmaster or the board of examiners. ”

“ Statements and declarations is the expression,-what the applicant states, and what the applicant declares. Nothing can be more simple. If he makes any statement in the application, it must be true. If he makes any declaration in the application, it must be true. ”

“ Section 528.1 of the Rules of the New York Court of Appeals for the Admission of Attorneys and Counsellors-at-Law requires that the character and general fitness specified in Judiciary Law § 90 'must be shown by the affidavits of two reputable persons residing in the city or county in which (the applicant) resides, one of whom must be a practicing attorney of the Supreme Court of this State.' [3] The Committees also require the applicant himself to fill out a questionnaire. [4] After receipt of the affidavits and questionnaire, the Committees conduct a personal interview with each applicant. ”

“ After all, the judge is the final arbiter; he must be satisfied that the applicant is “in all respects qualified to be a citizen,” and, if he chooses to regard a person who cannot make sense out of a current newspaper as not thus qualified, he can deny the application on general principles. ”

“ In making appointments in the clerical force of the Department, strict attention has been given to the qualifications of applicants, no appointments being made to clerkships of any grade until the applicant has been subjected to an examination touching his fitness for the position. ”

“ The registrar shall take all necessary steps for obtaining the determination of an appeal or application under this Act, and shall obtain and lay before the Appeal Court in proper form all documents, exhibits and other things relating to the proceedings in the court-martial by which the appellant or applicant was tried which appear necessary for the proper determination of the appeal or application. ”

“ After consulting the head of any Department or office the Commission may from time to time designate, subject to the approval of the President, the positions therein for which applicants may be required to pass the special examination.
RULE XI.
1. Every application, in order to entitle the applicant to appear for examination or to be examined, must state under oath the facts on the following subjects: (1) Full name, residence, and post-office address; (2) citizenship; (3) age; (4) place of birth; (5) health and physical capacity for the public service ”

“ Each special examination shall embrace, in addition to the special subject upon which the applicant is to be tested, as many of the subjects of the clerk examination as the Commission may decide to be necessary to test fitness for the place to be filled. ”

“ An applicant for admission to practice law may justly be deemed to be aware of the traditions of the profession which he is joining, and to know that one of these traditions is that a lawyer is an officer of the court obligated to represent indigents for little or no compensation upon court order. ”

“ Naturally, the first depositions given are friendly to the applicant, so that their statements are as good as valueless, but among them there invariably occurs a reference to a somebody else who can shed a little light on the matter, and then it becomes the duty of the examiner who has taken that information to refer to the someone mentioned when he sends the summary of his interview to the department. ”

“ Each application or nomination shall include--
(1) the name of the applicant or nominee and a description of the interests such person shall represent; (2) evidence that the applicant or nominee is authorized to represent parties related to the interests the person proposes to represent; (3) a written commitment that the applicant or nominee shall actively participate in good faith in the development of the rule under consideration ”

“ Ordered, That rules 69 and 70 be rescinded, and applicants for license to practice law in the courts of this State, on presenting to any member of this court a certificate of qualification, signed by the Circuit Judge and State's Attorney of the circuit in which the applicant may reside, setting forth that the applicant has been examined and found qualified, will be a sufficient voucher on which to grant a license. ”

“ As it is apparent from the last section that there can be no reconsideration by a lodge of a rejected petition, the question will naturally arise, how an error committed by a lodge, in the rejection of a worthy applicant, is to be corrected, or how such a candidate, when once rejected, is ever to make a second trial, for it is, of course, admitted, that circumstances may occur in which a candidate who had been once blackballed might, on a renewal of his petition, be found worthy of admission. ”

“ The verification of a diploma consists in an affidavit of the holder and applicant that he is the person therein named, taken before any person authorized to administer oaths, attested under the hand and official seal of the official, if he have a seal; graduates may present their diplomas and affidavits by letter or proxy. ”

“ It is sometimes difficult to write a letter of application, because one must speak of himself and of his ability to fill the position sought, and to do so without seeming egotistic. If the applicant has had experience in work similar to that for which he applies, a simple statement of the fact, the length of time engaged in such work, the reason for quitting his last position, and the name and address of his former employer, should form the substance of his letter. ”

“ Such affidavits much state that the applicant is, to the knowledge of the affiant, a person of good moral character and must set forth in detail the facts upon which such knowledge is based. Such affidavits shall not be conclusive, and the court may make further examination and inquiry through its committee on character and fitness or otherwise. ”

“ You are curious to see such a paper, and one of the aspirants, perhaps considering you an important man, will be very glad to hand it to you, maybe to obtain your signature, too, in his favor. And what do you read? The applicant for office is represented to be the model man of the age in point of character, of intelligence, of capacity and of political merit; he is just the man for such a place, and it would inflict serious damage on the country not to appoint him. ”

“ Social investigation as defined and described * * * shall be made of each application or reapplication for public assistance or care as the basis for determination of initial eligibility.
'a. Determination of initial eligibility shall include contact with the applicant and at least one home visit which shall be made promptly in accordance with agency policy. ”

“ For the following named offices the names of male eligibles are entered on only one register—namely, the “clerk” or the “carrier” register—and male applicants for these offices must indicate in their applications whether they desire the position of “clerk” or of “carrier:”
Examinations for the first and second-class offices in the following list will be held only when eligibles are needed, due announcement of which will be made, and application blanks will not be given out until the examinations are announced. ”

“ Examinations are in all cases first made of applicants within the office or department, and from the list three reported in the order of excellence; if those within fail, then outside applicants may be examined. ”

“ Persons who wish to obtain their services are requested to make written application, on which printed 'authorities' are transmitted to approved applicants, who, on presenting them at the depôt, are at liberty to make arrangements with the immigrants by mutual consent, the women receiving such advice and information as they may require. ”

“ U.S.Const., Art. VI, cl. 2:↑ Rule 9406 does not itself directly impinge upon applicants; it is rather an instruction to the appellees, touching applicants only as filtered through the appellees' construction.↑ As this case comes to us from the District Court, the sum total of what applicants must do in the first instance to satisfy any 'burden' placed upon them by the Rule is simply to answer two questions on the questionnaire they submit to the appellee committees. ”

“ INTERVIEWS OF APPLICANTS.—To assist the nonpartisan agency in developing the selection pool under this subsection, the nonpartisan agency shall conduct interviews of applicants under oath. If an individual is included in a selection pool developed under this section, all of the interviews of the individual shall be transcribed and the transcriptions made available on the nonpartisan agency’s website contemporaneously with release of the report under paragraph (6) . ”

“ A vacancy occurring in the lowest grade of any group of offices shall be filled, after due public notice, from all applicants who shall present themselves, and who shall have furnished the evidence and satisfied the preliminary examination already mentioned, and who shall have passed a public competitive examination to test knowledge, ability, and special qualifications for the performance of the duties of the office. ”

“ And in all cases, when an office becomes vacant in your State, as the distance would occasion a great delay, were you to wait to be regularly consulted, I shall be much obliged to you to recommend the best characters. There is nothing I am so anxious about as making the best possible appointments, and no case in which the best men are more liable to mislead us, by yielding to the solicitations of applicants. ”

“ If the applicant is not domiciled in the United States the applicant may designate, by a document filed in the United States Patent and Trademark Office, the name and address of a person resident in the United States on whom may be served notices or process in proceedings affecting the mark. Such notices or process may be served upon the person so designated by leaving with that person or mailing to that person a copy thereof at the address specified in the last designation so filed. ”

“ Where a claim has been rejected for publica­tion without statutory notice, and the applicant resubmits the material with a good notice but without reference to the earlier rejection, the claim will again be rejected if the new application contains the same date of publication or a date earlier than that of the letter of rejection. ”

“ On the year’s average, I am assured, there are 30 applications daily, but only ten new applicants, as men call to solicit an engagement again and again. Thus in the year there are nine thousand, three hundred, and ninety applications, and 3130 individual applicants. ”
