Eligibility

“ ELIGIBILITY, REQUIREMENTS, QUALIFICATIONS, EXAMINATION, METHODS OF SELECTION, METHODS OF PROCEDURE AND INSTRUCTION
The Rhodes Trust now issues Memoranda which deal with the regulations and instructions which govern the eligibility and selection of candidates in their respective centres. Information may be had from the Local Committees. [32] A brief condensation of these regulations as they appear at present will answer most of the technical questions which may present themselves to a prospective candidate.
Eligibility.
Candidates must be subjects of those countries which they represent, i. e. ”

“ Social investigation as defined and described * * * shall be made of each application or reapplication for public assistance or care as the basis for determination of initial eligibility.
'a. Determination of initial eligibility shall include contact with the applicant and at least one home visit which shall be made promptly in accordance with agency policy. ”

“ No applicant for competitive examination, or eligible on any civil service register, or officer or employee in the executive civil service, shall directly or indirectly persuade, induce, or coerce, or attempt to persuade, induce, or coerce any prospective applicant, applicant, or eligible to withhold filing application or to withdraw from competition or eligibility for positions in the competitive classifted civil service, for the purpose of either improving or injuring the prospects or chances of any such applicant or eligible. ”

“ The presumption always is, that a person chosen to an office is qualified to fill it, and it is never incumbent upon him to prove his eligibility. The certificate of election does not add to this presumption, but simply leaves it where the law places it, and he who denies the eligibility of a person who is certified to be elected, must take the burthen of proving that he is not eligible. ”

“ Citizenship is membership in a political society, and implies a duty of allegiance on the part of the member and a duty of protection on the part of society. These are reciprocal obligations, one being a compensation for the other. Under our Constitution, a naturalized citizen stands on an equal footing with the native citizen in all respects save that of eligibility to the Presidency. ”

“ Pursuant to this power, Congress may establish a system of registration for individuals liable for training and service, and may require such individuals, within reason, to cooperate in the registration system. The issuance of certificates indicating the registration and eligibility classification of individuals is a legitimate and substantial administrative aid in the functioning of this system. ”

“ Eligibility and assistance Nothing in this subchapter shall be construed to change the authority or the responsibility of a Federal agency to determine the terms and conditions of eligibility for, or the amount of assistance provided by a direct loan or a loan guarantee. ”

“ Re-eligibility makes him an officer for life, and the disastors inseparable from an elective monarchy, render it preferable, if we cannot tread back that step, that we should go forward & take refuge in an hereditary one. ”

“ Such steps may include outreach efforts such as the outstationing of eligibility workers, entering into agreements with the Indian Health Service, Indian Tribes, Tribal Organizations, and Urban Indian Organizations to provide outreach, education regarding eligibility and benefits, enrollment, and translation services when such services are appropriate. ”

“ In addition to the names of persons who qualify in competitive examinations, the names of persons who have lost eligibility on a career or career-conditional register because of service in the armed forces, and the names of persons who lost opportunity for certification or who have served under career or career-conditional appointment when the Commission determines that they should be given certification, may also be entered at such places on appropriate registers and under such conditions as the Commission may prescribe. ”

“ And since the finding of eligibility involves questions of fact and law, paragraph (4) of § 106 (a) might be read to require that this finding be based on substantial evidence in the record. See Comment, 111 U. of Pa.L.Rev. 1226, 1229 (1963) . ”

“ Randolph's fifth proposition relative to qualifications of the members of the second branch, considered — Motion that the members of the second branch shall be of the age of thirty years — Agreed to — Shall hold their offices for the term of seven years — Agreed to — Shall be entitled to no compensation — Disagreed to — Shall be subject to the same qualifications, as to compensation and ineligibility, as the members of the first branch — Agreed to. ”

“ These two words are not justly susceptible of any such signification, especially in a National Constitution, which is to be interpreted always so that Human Rights shall not suffer. I do not stop now for dictionaries. The case is too plain. A “qualification” is something that can be acquired. A man is familiarly said to “qualify” for an office. Nothing can be a “qualification” which is not in its nature attainable,—as residence, property, education, or character, each of which is within the possible reach of well-directed effort. Color cannot be a “qualification.” ”

“ And it ought to be particularly noticed, that although each of those judges gave a decision against the licentiates, yet they each observed, that, according both to the spirit and the letter of the original statutes of the College, the licentiates were admissible to the fellowship after due examination: but, inasmuch as the fellows were empowered to make by-laws, and the licentiates had accepted their license under those by-laws, the College could not be compelled to admit those as fellows who had accepted their license under laws which excluded them from the fellowship. ”

“ The professed is now eligible to certain offices in the Society, and he may remain as a professed father of the three vows for the rest of his life. The highest class, who constitute the real core of the Society, whence all its chief officers are taken, are the professed of the four vows. This grade can seldom be reached until the candidate is in his forty-fifth year, which involves a probation of thirty-one years in the case of those who have entered on the novitiate at the earliest legal age. ”

“ Government officers, ministers or religious teachers, missionaries, lawyers, physicians, chemists, civil engineers, teachers, students, authors, artists, merchants, and travelers for curiosity or pleasure, nor to their legal wives or their children under sixteen years of age who shall accompany them or who subsequently may apply for admission to the United States. ”

“ Every applicant for examination must be a citizen of the United States, must be of proper age, and must make an application under oath upon a form prescribed by the Commission and accompanied by such certificates as may be prescribed. ”

“ It may be that it will be most useful both to young men of draft age and to other readers if we concentrate largely on the quite concrete problem of whether the former should register, conform to other requirements of the Selective Service Act which apply to conscientious objectors and accept or submit to the alternative service required of them under the law as amended in June, 1951 ”

“ And in case any such alien applying for admission to become a citizen of the United States, shall have borne any hereditary title, or been of any of the orders of nobility in the kingdom or state from which he came, in addition to the requisites of this, and the before recited act, he shall make an express renunciation of his title, or order of nobility, in the Court to which his application shall be made, before he shall be entitled to such admission ”

“ You are to be particularly careful, that those whom you choose be duly qualified according to law, and that no deceit be practised in obtaining temporary qualifications. You ought to enquire into their estates, and how they came by them; and if they have none, as many who stand candidates, I am told, have not, you may guess who assists them, and what hopeful services are expected from them. ”

“ The following is an imperfect enumeration of them:—An expression of the will of the legislature, when it makes any disposition with regard to property; Occupancy, when a man takes what belongs to nobody; Labour; Donation; Contract; Succession. Of these six causes of the commencement of a right there is a remarkable distinction between the first three and the last three. The first three give commencement to a right in favour of one individual, without necessarily putting an end to a right enjoyed by any other individual. ”

“ No one is removed from a list of eligibles by the mere fact that he is not kept upon another list of higher or superior degree.
14. Inscription upon a list of eligibles is necessary only with reference to those of the public officers for which that condition is expressly required by the constitution or the law. The list of eligibles shall be formed for the first time during the course of the Year IX.
Citizens who shall be selected for the first formation of the constituted authorities, shall form a necessary part of the first lists of eligibles. ”

“ I direct that of the two Scholarships appropriated to a State or Territory not more than one shall be filled up in any year so that at no time shall more than two Scholarships be held for the same State or Territory. ”

“ The exempt property may be selected by the debtor, or on his failure to make such selection, some States permit the wife to make the selection, but in case no selection is made, the proper officer will make the selection for them. ”

“ All the cases establish the power of the king to make the grant, or the right of the subject to hold by prescription, which pre-supposes a grant from the crown as the only lawful commencement of the title. ”

“ In other states any body of men may secure articles of incorporation of a college or school by paying the necessary state fee, without question as to the ability of the incorporator to furnish an education. ”

“ Except as otherwise provided in this title, it shall be the duty of every male citizen of the United States, and every other male person residing in the United States, who, on the day or days fixed for the first or any subsequent registration, is between the ages of eighteen and twenty-six, to present himself for and submit to registration at such time or times and place or places, and in such manner, as shall be determined by proclamation of the President and by rules and regulations prescribed hereunder. ”

“ HAND ENROLLMENT.—The term 'hand enrollment' means the enrollment, as authorized by section 1, of a bill or joint resolution for presentment to the President in a form other than the printed form required by sections 106 and 107 of title 1, United States Code. ”

“ ELIGIBLE ENTITY- The term `eligible entity' means a State, an Indian tribe or tribal organization, an institution of higher education, a local workforce investment board established under section 117 of the Workforce Investment Act of 1998, a sponsor of an apprenticeship program registered under the National Apprenticeship Act or a community-based organization. ”

“ Admission into this society is an affair of the most strict and ceremonious proof, as to the sixteen quarterings in the arms of the candidate, each of which must be unblemished by any plebeian symptoms. ”

“ If a State declares that an entire class of citizens is ineligible for the position of Elector, and that class is defined in a way in which individual merit plays no part, it strikes at the very basis of the College as it was originally conceived. ”

“ A State can require high standards of qualification, such as good moral character or proficiency in its law, before it admits an applicant to the bar, but any qualification must have a rational connection with the applicant's fitness or capacity to practice law. ”

“ Let the register give the name, address, and asserted qualification of each candidate—as licentiate, or doctor, or what not, of this or that college, hall, university, &c., home or foreign. Let it be competent to any man to describe himself as qualified by study in public schools without a diploma, or by private study, or even by intuition or divine inspiration, if he please. ”

“ Leupp, Commissioner of the General Land Office, to the Secretary of the Interior (Land 56330-1908 E. B. H.) , that the 'application for enrollment shall be construed, for the purposes of the government, as representing the age of the applicant at that time, and that the date of the application shall be held to be the anniversary of the date of birth, except where the records show otherwise.' It is always stated that the act shall be so construed 'for the purposes of the government.' This does not purport to be a result reached on a careful interpretation of the act ”

“ Thus it is clear that the crucial distinction in draft classifications is between individuals presently subject to induction and those who are not so subject, either because of deferment or exemption. ”

“ All persons acting as the agents of absentees, for the purpose of acquiring, managing, or registering grants of land, will be required to produce their credentials, and to follow the same course of proceedings as if the grant were for themselves, with the exception of that part which relates to registration, which must be effected in the name of the real owner. ”
