Trademark registration

“ Because one's trade name expresses one's identity, so long as a trade name is used in connection with a product only to the extent required to indicate one's business in customary ways, the effect of registration of an identical or similar trademark does not reach such trade name. On the other hand, if a name, title, or trade name is used in such a way as to conclude that it was used solely in order to distinguish one's own goods from someone else's goods, legal rights of another person's registered trademark take effect on such mark. ”

“ In some of these countries not only is registration of trademarks required as a prerequisite to the recognition ot his legal right to its exclusive use, but registration, which is in this country public notice of the claim of an exclusive right to a particular mark and nothing more, is considered of such importance that the first to file the mark for registration is by law the owner of the mark. ”

“ Trademarks shall include service marks and collective marks, and may include certification marks. A Party may require, as a condition for registration that a sign be visually perceptible.
2. Each Party shall provide to the owner of a registered trademark the right to prevent all persons not having the owner's consent from using in commerce identical or similar signs for goods or services that are identical or similar to those goods or services in respect of which the owner's trademark is registered, where such use would result in a likelihood of confusion. ”

“ The unauthorized registration may infringe upon the distribution order of a fair and creditable product because such trademarks free-ride on the fame of the deceased and as a result has unfairly absorbed the consumer's purchase. So such trademark can be properly viewed as within the purview of Item 4 of Paragraph 1 of Article 7 of the Trademark Act. In such a case, had the artist been alive, it amounts to an infringement of personal rights as an artist to use the artist's signature indicating artworks as his or her own by means of unauthorized registration and proclamation. ”

“ Owners of trademarks used in commerce with foreign nations, or among the several States, or with the Indian tribes, provided such owners shall be domiciled in the United States, or located in any foreign country which, by treaty, convention, or law, affords similar privileges to the citizens of the United States, may obtain registration of such trade-marks by complying with the following requirements. ”

“ Procedural Aspects of Examination, Opposition and Cancellation Each Party shall provide a system for the examination and registration of trademarks which includes among other things:
(a) communicating to the applicant in writing, which may be by electronic means, the reasons for any refusal to register a trademark; (b) providing the applicant with an opportunity to respond to communications from the competent authorities, to contest any initial refusal, and to make a judicial appeal of any final refusal to register a trademark ”

“ It gives at most a mere color of protection. It provides a means by which owners of certain trademarks may, if they choose, give notice of their claims to an exclusive right in such marks, warning mankind against trespassing upon such rights, but does not make such notice effective to give the registrant any substantial advantage against infringers which he may not have without registration. ”

“ No country other than the United States has in its constitution a provision limiting the power of the General Government to regulate commerce generally, and all countries which have any pretension to commercial importance provide in their trademark laws for the registration and protection of the trademarks of their citizens or subjects without regard to the kind of commerce in which they are used, and no question of the constitutionality of such laws appears to have arisen in any foreign country. ”

“ That a manufacturer or dealer engaged in a particular line of business should unintentionally select as a mark for a particular class of goods sold by him the same mark which has previously been used by another for the same class of goods as a matter of fact has repeatedly happened. So many instances of the adoption by two or more traders of substantially the same mark were found when the trademark registration act of 1875, of Great Britain, went into effect that it was found necessary to frame a rule known as the "three-mark rule," under which identical or similar "old marks," i. ”

“ And because that is so, the producer of a quality product may derive significant value from its marks. They ensure that the producer itself—and not some “imitating competitor”—will reap the financial rewards associated with the product’s good reputation. Ibid.
To help protect marks, the Lanham Act sets up a voluntary registration system. Any mark owner may apply to the Patent and Trademark Office to get its mark placed on a federal register. ”

“ Moreover, based on their prior trademark registration, the court below found that, as of the registration decision date of the trademark of this case, the conflicting trademarks No.3 and 4 are widely known to the extent that they are recognized by consumers and transaction partners as the defendant's trademarks. ”

“ Each Party shall prohibit the registration as a trademark of words, at least in English, French or Spanish, that generically designate goods or services or types of goods or services to which the trademark applies.
14. Each Party shall refuse to register trademarks that consist of or comprise immoral, deceptive or scandalous matter, or matter that may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs or any Party's national symbols, or bring them into contempt or disrepute. ”

“ When subject to the control of its owner, use of a trademark by another person shall be recognized as use of the trademark for the purpose of maintaining the registration.
Article 20. Other Requirements The use of a trademark in the course of trade shall not be unjustifiably encumbered by special requirements, such as use with another trademark, use in a special form or use in a manner detrimental to its capability to distinguish the goods or services of one undertaking from those of other undertakings. ”

“ Trademarks help consumers distinguish a company's products and services from competing products and services, and thereby serve a critical source identification role. The goodwill represented in a company's trademarks is often one of the company's most valuable business assets. However, in numerous countries legal and procedural obstacles exist to securing and enforcing trademark rights. Additionally, many countries lack transparency and consistency in administrative registration procedures. ”
