“ My observance has been that our plan of organization automatically raises the ethical standards of the profession. There is an instinctive desire on the part of every member of the bar to conform to the high ideals of the profession, and to the code of ethics prescribed by the organization to which he belongs. ”

“ That the lien of a rural credit mortgage is not superior to the lien for taxes, and that it is the duty of the Rural Credit Board to pay taxes on lands covered by its mortgage loans when they become delinquent, out of any funds which it can use in making loans, as the payment of taxes is an incident to the making of loans. ”

“ In his opinion, the average youthful criminal operates upon the theory that the world owes him a living. Justice Cropsey, therefore, finds that moral, instead of mental, deficiencies account for most criminal acts. According to his observations, the criminal proclivities of the young are due to inadequate home training and to the decline of religious influences. Justice Cropsey says that the young criminal is easily led into radicalism, a fact which shows that his predisposition to crime is in part an outgrowth of his political and economic education. ”

“ As a matter of fact, a jury should be selected for its intelligence, its ability to reason and weigh one bit of evidence against another, rather than for a lack of intelligence or disinterestedness in matters of public import. But it is the latter that attorneys frequently demand. It is the kind of a jury the attorneys are trying to find in Chicago, and if they keep at it long enough, they’ll find it. ”

“ War Debts as a Menace to International Peace; The Possibilities of Disarmanent; Foreign Investments and International Peace; Can the Feeling of Insecurity in Europe be Eliminated Without the Co-operation of the United States?; The Outlawry of War. It is the wish of President Cupler that any North Dakota attorneys who contemplate being in the East at that particular time communicate with him at once, to the end that the Association may be represented at these sessions, if possible. ”

“ Who would want to trust the lives of individuals or the rights of society to those who have previously formed opinions? Who having formed an opinion, can judge matters brought before him with due regard for the rights of all parties concerned? ”

“ One of the problems that confronts every organized effort, whether fraternal, political or professional, is that of making effective the pronouncements of policy by the largest group. “ We believe if the license to practice be taken away from respondent for a period of time he will come to a fuller realization of what it means to be entrusted with a license to practice the profession of law. ”

“ Actual notice consists in express information of a fact; a person is deemed to have notice of a fact when he has actual notice of circumstances sufficient to put a prudent man upon inquiry as to the existence of such fact, and who omits to make inquiry.
4. For the reasons stated in the opinion, it is held, that it was error to withdraw testimony from the consideration of the jury tending to show constructive notice of the agreement that title to the furnace should not pass to the vendee, plaintiff's grantor, until after satisfactory trial of the plant. ”

“ Cleveland Electric Ry., recently said: “No public utility enjoying monopoly in its field can make closed shop union contracts with any kind of labor. Closed shop union contracts are contrary to public policy on the theory that they might bar from employment individuals not wanting to join a labor union.” ”

“ Suit to establish an equitable claim to specific property does not bar a recovery of the proceeds of that property if it develops in the course of the trial that the defendant has conveyed it away in violation of his equitable obligation to the plaintiff. ”

“ Present plans are to draft members of the Bar Association to deliver two addresses in each High School before the close of the present school year, the students to participate in the arrangement of the programs and to introduce the speakers. It is also proposed to invite parents and friends to attend the programs. The first address is contemplated to cover the necessity for laws and the reasons why laws should be obeyed; the second is to deal with the same general subject and to present a plan for the better co-operation of citizens generally with officers to secure better law enforcement. ”

“ There may be a good many unpalatable but perfectly true statements in the press on the subjects mentioned that deserve to be read and digested and, at times, to become the subject of letters of approval instead of criticism. But no matter what the purpose of the letter may be, brevity, genuine argument based on facts, and good temper are essential to give it effectiveness, for the object is to reach the public quite as much as the newspaper. ”

“ That whatever may be the rule in an action to enforce the mortgage in an action for conversion, the question of the existence of the property claimed to have been converted is not concluded by the covenants of ownership and warranty as to existing property. ”

“ Members of the profession in every state can render a genuine public service by answering temperately, concisely and effectively, erroneous statements in the public press which reflect seriously upon the courts or the profession. ”

“ The treasurer of any city, town or village comprising a special district shall be the treasurer of the board of education thereof; provided, however, should the said special school district have within its boundaries and be comprised partly of territory without the limits of said city, town or village, then the said special school district shall elect, at its regular elections, a treasurer in the manner provided by law for the election of school district treasurer. ”

“ Just kindly remember that the committee has already put in considerable time and effort for you, but in order to reap the full benefit of the work of that committee it will be necessary for you to exhibit some degree of promptness, in return.
Expressions from some members of the Association indicate that there are a number who do not favor such “pooled” purchases. It is suggested to those of that opinion that they return the order blank to the Chairman of the Committee, with the notation that they will require no such supplies during the year. ”

“ Under the constitution of this state all governmental power is vested in the legislature, except such as is granted to the other departments of government, or expressly withheld from the legislature by constitutional restrictions. (2) The only test of the validity of an act regularly passed by the legislature is whether it violates any of the express or implied restrictions of the state or Federal constitutions. ”

“ He also understands and appreciates it is hoped, that there can be no “world peace” until men and women learn to live in peace, as friends, as neighbors, as citizens—in the same country, in the same state, in the same community, in the same neighborhood. ”

“ The reporters and their advisors and assistants have been busily engaged for approximately a year and a half on the re-statement of the law of Torts, Conflict of Laws, Contracts and Agency. To date a portion of the re-statement of the law of Contracts, namely, that covering the Promotion of Contracts, has been sent to the Council for its consideration, as has also the subject of Domicil in the topic Conflict of Laws, and that portion of the law of Torts which deals with Battery, Assaults and False Imprisonment. ”

“ Nothwithstanding the fact that existing disease or infirmity may have predisposed the employee to apoplexy, his dependents may be entitled to compensation if the rupture of the blood vessel, with resulting apoplexy, took place earlier because of the excessive artificial heat, under which the employee labored. Acceleration of a pre-existing disease to a fatal conclusion is, in such circumstances, an injury within the compensation law. ”

“ The taxes on the property, including the indemnity hail tax, were not paid and the land was sold at tax sales to McLean County. The action is to foreclose a real estate mortgage and the county claims the indemnity hail tax to be a prior lien along with other taxes. HELD: The indemnity hail tax provided by Chapter 77, Laws of 1921, is not a tax within the purview of the constitution of this state, and such tax does not create a lien paramount to an antecedent real estate mortgage. ”

“ While ordinarily the business program and banquet have always been the most important part of every meeting, the Cass County Association plans to provide in addition thereto entertainment for every hour not actually used in the regular business of the meeting.
The Committee in charge are particularly anxious to have a full attendance of not only the lawyers but also their ladies. To that end a Women’s Auxiliary has been formed under the direction of Mrs. A. W. Cupler of Fargo. The Auxiliary will provide entertainment for all visiting ladies. ”

“ Full and free discussion alone may be expected to result in action that may be said to be representative of the composite opinion of the Bar membership. Free discussion may be obtained if the membership is confronted only with a program, that is, it will be free discussion among those who happen to be present, but the urge to be present will be much stronger if they know in advance what proposals are pressing for consideration, and the greater the attendance the fuller will be the discussion and the more representative the resulting action. ”

“ The meeting is fixed at a time when it is hoped most of the routine legislation will be out of the way. There is no legislation in which the Committee is interested that is of a partisan nature, and the Committee will not assist in the passage of or defeat of partisan legislation. Changes must be made in the present laws and new laws must be adopted in order to keep pace with the advancing lines of civilization. ”

“ The Constitution is not self-perpetuating. If it is to survive, it will be because it has public support. Such support is not a passive but an active operation. It means making adequate sacrifice to maintain what is of general benefit. ”

“ HELD further that before a juvenile court may commit a child to the state training school it must be found that the child is delinquent, and that the parents, guardian or custodian are unfit or improper guardians, or are unwilling to care for, protect, educate or discipline the child, and that it is for the interest of the child and the people of the state that the child be taken from the custody of its parents, custodian or guardian. ”
